The Commission is being asked to act on a Memorandum and Order responding to a petition by Entergy Nuclear Operations, Inc. for interlocutory review of the September 21, 2012, Board Order granting cross-examination to New York State, and Entergy's companion request to stay the Board Order or the upcoming evidentiary hearing, pending resolution of its petition. The Commission has voted to approve a Memorandum and Order, which denies Entergy's petition for review, provides guidance to the Board, and denies Entergy's stay request as moot. Commissioner Apostolakis did not participate in this matter. Would Chairman Macfarlane and Commissioner Ostendorff please affirm your votes? CHAIRMAN MACFARLANE: Aye. COMMISSIONER OSTENDORFF: Aye.
