PROCEEDINGS CHAIRMAN BURNS: Well call this affirmation session to order. Madam Secretary, we have one item to come before us.
ANNETTE VIETTI-COOK: This is on SECY-15-0157 Entergy Nuclear Operations, Inc.
(Indian Point Nuclear Generating Units 2 and 3). The Commission is being asked to act on a Memorandum and Order responding to the State of New Yorks petitions for review of the Atomic Safety and Licensing Boards decision in LBP-13-13 to the extent that the decision resolved Contention NYS-12C, and an April 1, 2014, Board decision that declined to reconsider LBP-13-13 or reopen the hearing record on NYS-12C.
The Commission has voted to approve a Memorandum and Order that reverses LBP 13, directs further Staff action, and declines to review the April 1, 2014, decision. Chairman Burns did not participate in this matter. Would Commissioner Svinicki, Commissioner Ostendorff, and Commissioner Baran, please affirm your votes?
COMMISSIONER SVINICKI: Aye.
COMMISSIONER OSTENDORFF: Aye.
COMMISSIONER BARAN: Aye.
