3 [9:25 a.m.] P R O C E E D I N G S  CHAIRMAN KLEIN: Good morning. Before we begin our EEO and small business discussions, I believe we have an affirmation. Madam Secretary?
MS. VIETTI-COOK:    We have one item for affirmation, and for people that may have been here watching for the security rulemaking, it is being postponed. Please watch our website; as soon as we know we're going to do it we'll put it up on the website. This is on Entergy Nuclear Operations Indian Point Nuclear Generating Station Units 2 and 3. The Commission is being asked to act on a Memorandum and Order responding to an appeal of Westchester Citizen's Awareness Network, Rockland County Conservation Association, Public Health and Sustainable Energy, Sierra Club - Atlantic Chapter, and New York State Assemblyman Richard Brodsky (collectively, WestCAN) challenging the Board's July 31 Order that struck WestCAN's request for hearing. The Commission has voted to approve a Memorandum and Order which affirms the Board's July 31 Order, and finds that the Board reasonably dismissed WestCAN's request for hearing. Would you please affirm your votes?
CHAIRMAN KLEIN:  Aye.
COMMISSIONER JACZKO:  Aye.
COMMISSIONER LYONS:  Aye.
