By letter dated September 25, 2007, Mr. T. J. O
By letter dated September 25, 2007, Mr. T. J. O=Connor of MNGP submitted an application for amendment, including Enclosure 5, consisting of an affidavit dated October 5, 2006, executed by you and a document entitled "Monticello Nuclear Generating Plant SAFER/GESTR ECCS-LOCA Analysis - LPCI Loop Selection Detectable Break Area" (Proprietary). You requested that the document be withheld from public disclosure pursuant to Title 10 of the Code of Federal Regulations (10 CFR), Part 2, Section 2.390.
=Connor of MNGP submitted an application for amendment, including Enclosure 5, consisting of an affidavit dated October 5, 2006, executed by you and a document entitled "Monticello Nuclear Generating Plant SAFER/GESTR ECCS-LOCA Analysis - LPCI Loop Selection Detectable Break Area" (Proprietary). You requested that the document be withheld from public disclosure pursuant to Title 10 of the Code of Federal Regulations (10 CFR), Part 2, Section 2.390.  
The affidavit stated that the entire document (i.e., Enclosure 5 of the September 25, 2007, submittal) should be considered exempt from mandatory public disclosure for the following reasons:
 
(a)   The information discloses a process, method, or apparatus, including supporting data and analyses, where prevention of its use by General Electric=s competitors without license form General Electric constitutes a competitive economic advantage over other companies; (b)   The information which, if used by a competitor, would reduce his expenditure of resources, or improve his competitive position in the design, manufacture, shipment, installation, assurance of quality, or licensing of a similar product.
The affidavit stated that the entire document (i.e., Enclosure 5 of the September 25, 2007, submittal) should be considered exempt from mandatory public disclosure for the following reasons:  
We have reviewed Enclosure 5 of the September 25, 2007, letter in accordance with the requirements of 10 CFR 2.390, and on the basis of your statements, we have determined that the submitted information sought to be withheld contains proprietary commercial information and should be withheld from public disclosure.
 
Therefore, the entire document identified above, which is marked as proprietary, will be withheld from public disclosure pursuant to 10 CFR 2.390(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.
