ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION This is to inform the Commission that a White Significance Determination Process (SDP) finding will be issued on or about September 14, 2009, to Carolina Power and Light Company (CP&L) as a result of inspections at the Brunswick Steam Electric Plant. This White finding, an issue with low to moderate safety significance, which may require additional NRC inspections, involved the failure to perform an adequate design modification to their emergency diesel generators (EDGs) such that local control of the EDGs could not be established as required by the Safe Shutdown Analysis Report. The finding involved a failure to correctly designate termination points for linking control power to the EDG lockout relay reset circuitry during the implementation of a design change which resulted in a loss of EDG local control function. A Regulatory Conference was held on July 28, 2009, in which CP&L provided their assessment of the significance of the finding (i.e., Green), root causes, and detailed corrective actions. After considering the information obtained from the Regulatory Conference, the NRC concluded that the inspection finding was appropriately characterized as White. Subject:
A Notice of Violation is included based on a violation of Appendix B of 10 CFR 50, Criterion III, Design Control, which requires, in part, that measures shall be established to assure that the design basis are correctly translated into specifications, drawings, procedures and instructions.
Contrary to this requirement, during the implementation of an Engineering Change Notice, the licensee failed to correctly replace control relays on all four EDGs. The termination points for linking control power to the EDG lockout relay reset circuitry were incorrectly designated, such that the EDGs could not be operated locally.
It should be noted that the licensee has not been specifically informed of the enforcement action.
The schedule of issuance and notification is:
Mailing of Final Significance Determination September 14, 2009 Telephone Notification of Licensee September 14, 2009 The State of North Carolina will be notified.
