I am writing to request reinitiation of informal consultation pursuant to section 7 of the Endangered Species Act of 1973, as amended (ESA) for Turkey Point Nuclear Generating Unit Nos. 3 and 4 (Turkey Point). The U.S. Nuclear Regulatory Commission (NRC) is in the process of reviewing Florida Power & Light Companys (FPLs) license amendment requests (LARs) that would revise Appendix A of the Turkey Point renewed facility operating licenses and increase the ultimate heat sink (UHS) thermal limit from 100°F to 104°F. FPL submitted its request on July 10, 2014, and supplemented its request by letters dated July 17, July 22, and July 24, 2014. In its July 17, 2014, letter, the licensee requested the NRC to process the LAR expediently. If approved, the license amendment would be effective from the date of NRC approval through the expiration dates of the renewed operating licenses. | |||
The NRC has prepared the enclosed biological assessment for your review. In it, the NRC concludes that the LAR may affect, but is not likely to adversely affect the American crocodile and that the LAR would have no effect on designated American crocodile critical habitat. | |||
The UHS temperatures have recently approached and exceeded the 100°F Technical Specification limit on several occasions. On July 20, 2014, the NRC approved a notice of enforcement discretion (NOED), which allows the UHS temperature to exceed 100°F up to 103°F for a period of no more than 10 days, as well as several other NOED exit criteria. The NRC documented the NOED in a letter to FPL dated July 23, 2014. The NRC intends to make a decision on the LAR on an expedited schedule. Given the nature of the situation, the NRC requests your review of and concurrence with the enclosed biological assessment by July 28, 2014. We have coordinated this request with Ms. Ashleigh Blackford and Mr. John Wrublik of your staff, and they are aware of the NRCs review timeline for this action. | |||

The U.S. Nuclear Regulatory Commission (NRC) is in the process of reviewing Florida Power & Light Companys (FPLs) license amendment requests (LARs) that would revise Appendix A of the Turkey Point renewed facility operating licenses and increase the ultimate heat sink (UHS) thermal limit from 100°F to 104°F.
