OF NEI-17-06 ACCEPTANCE REVIEW LOGISTICS PUBLIC MEETING HELD ON MAY 14, 2021 On May 14, 2021, the U.S. Nuclear Regulatory Commission (NRC) met with the Nuclear Energy Institute (NEI) in a virtual public meeting to discuss the process that NRC will use to conduct the NEI 17-06, Rev. 0, Guidance on Using IEC 61508 SIL Certification to Support the Acceptance of Commercial Grade Digital Equipment for Nuclear Safety Related Applications (Agencywide Documents Access and Management (ADAMS) Accession No. ML21083A147) review for its endorsement. This list of meeting attendees is enclosed.
During this discussion, NEI made a presentation (ADAMS Accession No. ML21138A864) that explained how Draft B of the NEI 17-06 guidance document evolved into NEI 17-06, Rev. 0, which was submitted to the NRC on February 23, 2021 (ADAMS Accession No. ML21071A079).
The NRC staff presented its review approach for NEI 17-06, Rev. 0, and proposed a review schedule (ADAMS Accession No. ML21138A927) with milestones to support issuance of a new regulatory guide to endorse the guidance in NEI 17-06.
During the meeting, representatives from NEI questioned if the proposed review schedule could include a safety evaluation or endorsement by letter, rather than the regulatory guide development process. The NRC staff explained that a letter endorsement instead of a regulatory guide would not provide an opportunity for public comment or presentation for the Advisory Committee for Reactor Safeguards. A regulatory guide is the preferred method for endorsement as it would provide durable guidance that covers NEI 17-06 and address the regulatory linkage to EPRI TR 106439, Guideline on Evaluation and Acceptance of Commercial Grade Digital Equipment for Nuclear Safety Applications.

Morey                                        The NRC staff did explain that if a licensee volunteered to submit a Quality Assurance Plan change using the guidance in NEI 17-06, then the staffs safety evaluation could potentially be referenced by other licensees. Representatives from NEI expressed a preference to receive NRCs endorsement in calendar year 2022. The staff agreed to consider the schedule and any opportunities to implement efficiencies in the guidance development process.
The next public meeting to discuss the staffs preliminary comments on NEI 17-06, Rev. 0, and the schedule to conduct the actual guidance document review is planned for June 23, 2021.
