| U.S. Nuclear Regulatory Commission A TIN: Document Control Desk Washington, DC 20555-0001 Duane Arnold Energy Center Docket No. 50-331 License Amendment Request (TSCR-182): Proposed Changes to the Emergency Plan for Permanently Defueled Condition Pursuant to 1O CFR 50.90, NextEra Energy Duane Arnold, LLC (NEDA) requests an amendment to the license for the Duane Arnold Energy Center (DAEC). The proposed amendment would revise the DAEC Emergency Plan for the permanently defueled condition.

| The proposed changes are being submitted to the U.S. Nuclear Regulatory Commission (NRC) for approval prior to implementation, as required under 1O CFR 50.54(q)(4).

| By letter dated January 18, 2019 (Accession No. ML19023A196), NEDA provided formal notification to the NRC of the intention to permanently cease power operations at DAEC in the fourth quarter of 2020. Once the certifications of permanent cessation of power operations and of permanent removal of fuel from the reactor vessel in accordance with 10 CFR 50.82(a)(1 )(i) and (ii), respectively, are docketed for DAEC, 10 CFR 50.82(a)(2) stipulates that the 1O CFR Part 50 license will no longer authorize reactor operation or emplacement or retention of fuel in the reactor vessel.

| The proposed DAEC Emergency Plan changes would revise the on-shift staffing and Emergency Response Organization (ERO) staffing. NEDA has reviewed the proposed changes against the planning standards in 10 CFR 50.47(b) and requirements in 10 CFR Part 50, Appendix E and concludes that the standards and requirements will continue to be met.

| Attachment 1 provides the description and evaluation of the proposed changes. Attachments 2 and 3 provide the Emergency Plan with the proposed marked-up copy pages and clean copy pages, respectively. Attachment 4 provides the analysis of ERO tasks that will be transferred to remaining ERO positions.

| As presented in the evaluation, the proposed change does not involve a significant hazards consideration pursuant to 10 CFR 50.92, and there are no significant environmental impacts associated with the change. This change has been reviewed and concurred with by the DAEC Onsite Review Group.

| NEDA requests review and approval of the amendment by June 1, 2020 to support the current schedule to permanently defuel the DAEC. Further, NEDA requests that the approved amendment become effective following the docketing of the required 10 CFR 50.82(a)(1 )(ii) certification that the DAEC reactor vessel has been permanently defueled.
