ISSUANCE OF CONFIRMATORY ORDER This is to inform the Commission that a publicly available Confirmatory Order will be issued on or about April 6, 2016, to Entergy Operations, Inc. (licensee) confirming commitments reached as part of an alternative dispute resolution (ADR) settlement agreement addressing violations identified through an investigation at Waterford Steam Electric Station, Unit 3 (Waterford). | |||
The violations involved seven individuals at Waterford who deliberately failed to conduct compensatory hourly fire watch inspections and falsified their fire watch tour logs, and a licensee supervisor who deliberately failed to identify and take corrective actions when provided with information of suspected wrongdoing by fire watch individuals, contrary to the requirements in Title 10 of the Code of Federal Regulations (10 CFR) 50.48, Fire protection and 50.9, Complete and accuracy of information. In addition, a licensee manager deliberately provided incomplete and inaccurate information to an access authorization reviewing official regarding the trustworthiness and reliability of a contract fire watch individual, contrary to the requirements in 10 CFR 73.56, Personnel access authorization requirements for nuclear power plants and 50.9, Complete and accuracy of information. | |||
In a letter dated December 14, 2015, the U. S. Nuclear Regulatory Commission (NRC) provided the licensee with the results of the investigation, and offered the opportunity to attend a Predecisional Enforcement Conference, or to request ADR with the NRC. | |||
In response to the NRC letter, the licensee requested ADR. An ADR mediation session was held on February 19, 2016, and a preliminary settlement agreement was reached. The settlement actions include, but are not limited to: (1) conducting an Entergy Nuclear Fleet common causes evaluation, and, if general industry insights are identified, sharing them at an industry forum, (2) revising or issuing fleet-wide procedures to enhance Entergys management and oversight of supplemental workers, (3) provide the common requirements for fire watch programs, and (4) provide a process to address requests for the reinstatement of unescorted access authorization (UAA) for workers whose UAA has been temporarily suspended. | |||

ISSUANCE OF CONFIRMATORY ORDER This is to inform the Commission that a publicly available Confirmatory Order will be issued on or about April 6, 2016, to Entergy Operations, Inc. (licensee) confirming commitments reached as part of an alternative dispute resolution (ADR) settlement agreement addressing violations identified through an investigation at Waterford Steam Electric Station, Unit 3 (Waterford).
The violations involved seven individuals at Waterford who deliberately failed to conduct compensatory hourly fire watch inspections and falsified their fire watch tour logs, and a licensee supervisor who deliberately failed to identify and take corrective actions when provided with information of suspected wrongdoing by fire watch individuals, contrary to the requirements in Title 10 of the Code of Federal Regulations (10 CFR) 50.48, Fire protection and 50.9, Complete and accuracy of information.
