ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION AND NOTICE OF VIOLATION This is to inform the Commission that a Notice of Violation will be issued on or about March 28, 2014, to Entergy Operations, Inc. (Entergy) for a violation associated with a White Significance Determination Process finding identified during an inspection of the Waterford Steam Electric Station (Waterford), Unit 3. This White finding, an issue of low to moderate safety significance, will require additional U.S. Nuclear Regulatory Commission (NRC) inspections. The finding involves Entergys failure to establish an adequate test program to demonstrate that a safety-related component associated with the train B emergency diesel generator would perform satisfactorily in service. Specifically, Waterford personnel failed to identify and perform adequate testing on the train B emergency diesel generator exhaust fan to demonstrate that the exhaust fan would perform satisfactorily in service. This resulted in the train B emergency diesel generator being inoperable greater than the technical specification allowed outage time.
A Notice of Violation is included based on Entergys failure to meet 10 CFR Part 50, Appendix B, Criterion XI, Test Control, which requires, in part, that a test program be established to assure that all testing required to demonstrate that structures, systems, and components will perform satisfactorily in service is identified and performed in accordance with written test procedures which incorporate the requirements and acceptance limits contained in applicable design documents. In accordance with the NRC Enforcement Policy, the NOV is considered an escalated enforcement action because it is associated with a White finding.
The NRC issued a preliminary determination letter for this issue on January 30, 2014. On February 28, 2014, Entergy provided a written response agreeing with the characterization of the finding. After considering the information provided by Entergy, the staff concluded that the finding is appropriately characterized as White.
It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
