ORDER PROHIBITING INVOLVEMENT IN CERTAIN NRC-LICENSED ACTIVITIES, EFFECTIVE IMMEDIATELY This is to inform the Commission that an Order Prohibiting Involvement in NRC-Licensed Activities (Effective Immediately) will be issued today to Mr. Scott P. Wolfe. The Order is based on Mr. Wolfes having twice tested positive for an illegal substance during random fitness-for-duty tests while he held an NRC operators license at the Waterford-3 nuclear power plant in Killona, Louisiana. The NRC holds licensed reactor operators to high performance standards and entrusts them with assuring the public health and safety in the operation of nuclear power plants. Licensed reactor operators are expected to comply with all NRC requirements, including the fitness-for-duty requirements of the NRC (10 CFR Part 26) and the facility at which they are employed. Mr. Wolfes actions have violated the NRCs and the publics trust and demonstrated that he cannot be relied upon to comply with fitness-for-duty requirements.
Consequently, there is a lack of the requisite reasonable assurance that licensed activities can be conducted in compliance with the Commission's requirements and that the health and safety of the public will be protected if Mr. Wolfe were permitted at this time to hold an NRC operators license pursuant to 10 CFR Part 55. Therefore, the public health, safety, and interest require that this Order be immediately effective and that Mr. Wolfe be prohibited from applying for or holding an NRC operators license for a period of 3 years from the date of this Order.
It should be noted that Mr. Wolfe and the affected licensee (Waterford) have not been specifically informed of the enforcement action. The schedule of issuance and notification is:
