Part of the information that this response presents has been provided to CPAL by Seaboard Systems Railroad (Attachment I) for the sole purpose of assisting CPKL in providing to the Nuclear Regulatory Commission (NRC) information necessary to support the applications of CPAL and North Carolina Eastern Municipal Power Agency for an operating license for SHNPP.
Part of the information that this response presents has been provided to CPAL by Seaboard Systems Railroad (Attachment I) for the sole purpose of assisting CPKL in providing to the Nuclear Regulatory Commission (NRC) information necessary to support the applications of CPAL and North Carolina Eastern Municipal Power Agency for an operating license for SHNPP.
Seaboard 'System Railroad has requested that further disclosure of this information be limited to the NRC on the ground that the information constitutes confidential and/or proprietary commercial data.

Accordingly, CP&L hereby requests, pursuant to 10 CFR 2.790, that the information supplied by Seaboard System Railroad (Attachment I) be withheld from public disclosure. In support of this request, CPAL is transmitting herewith the letter of Seaboard Systems Railroad to the NRC requesting that the information be withheld and a supporting affidavit meeting the requirements of Section 2.790 which has been executed by Aubrey M. Daniel, Vice President Phosphate and Chemicals of Seaboard System Railroad. We request that the affidavit also be withheld from public disclosure.

The staff has requested that the applicant, using the guidance of RG 1.78, provide appropriate information and analyses of frequencies and quantities of shipments of other toxic materials (other than chlorine, for which the applicant has provided chlorine detectors that will detect-accidental release and automatically isolate the control room upon receipt of such a signal),   if any, that may be shipped on the nearby roads and railroads in the vicinity of the plant. To date, the staff has not received this information and regards this as an open item. The staff cannot reach a conclusion on this item until this information is received.

& Light Company (CPAL) hereby transmits one original and forty oopies of the response to the Shearon Harris Nuclear Power Plant (SHNPP) Draft Safety Evaluation Report (DSER)

Open Item 7.

Part of the information that this response presents has been provided to CPAL by Seaboard Systems Railroad (Attachment I) for the sole purpose of assisting CPKL in providing to the Nuclear Regulatory Commission (NRC) information necessary to support the applications of CPAL and North Carolina Eastern Municipal Power Agency for an operating license for SHNPP.

Seaboard

'System Railroad has requested that further disclosure of this information be limited to the NRC on the ground that the information constitutes confidential and/or proprietary commercial data.

Accordingly, CP&L hereby requests, pursuant to 10 CFR 2.790, that the information supplied by Seaboard System Railroad (Attachment I) be withheld from public disclosure.

In support of this request, CPAL is transmitting herewith the letter of Seaboard Systems Railroad to the NRC requesting that the information be withheld and a supporting affidavit meeting the requirements of Section 2.790 which has been executed by Aubrey M. Daniel, Vice President Phosphate and Chemicals of Seaboard System Railroad.

We request that the affidavit also be withheld from public disclosure.

The staff has requested that the applicant, using the guidance of RG 1.78, provide appropriate information and analyses of frequencies and quantities of shipments of other toxic materials (other than chlorine, for which the applicant has provided chlorine detectors that will detect-accidental release and automatically isolate the control room upon receipt of such a signal), if any, that may be shipped on the nearby roads and railroads in the vicinity of the plant.

To date, the staff has not received this information and regards this as an open item.

The staff cannot reach a

conclusion on this item until this information is received.

~Res ense The following paragraphs identify the information currently available on the shipment of toxic materials over transportation routes adjacent to the SHNPP.

There is one U. S.

Highway (U.S.

1) located 1.2 miles northwest of the plant, one North Carolina Highway (N.C. 02) located 4.3 miles southwest of the plant, and several secondary state roads within a five mile radius of the plant.

There is no reason to believe any hazardous chemicals are'shipped over the secondary roads and for the purposes of this evaluation, they have not been included.

Contact with numerous federal, state, and local agencies yielded very little information concerning hazardous chemical shipments.

, While Department of Transportation regulations apply to the shipment of hazardous materials and*hazardous

wastes, the regulations do not require disclosure of shipping routes.

Vendors of various chemicals in the Raleigh area were also contacted.

These companies had no specific information but indicated that the roads in the plant area, specifically U.S.

1, were used infrequently.

Interstate highways were the preferred routes.

A list of those persons contacted is shown on Table I.

. Within a five. mile radius of the plant, there are three segments of railroad, the Bonsai-Durham (2e5 miles northwest of the plant) and the Fuquay-Varina-Brickhaven (4.3 miles south of the plant) segments of the Norfolk Southern Railroad, and the Raleigh-Moncure segment (1.9 miles northwest of the plant) of the Seaboard System Railroad.

The Norfolk Southern Railroad currently ships about 13 cars per year of nitrogen fertilizer, which is an oxidizer, on those rail segments near our plant.

The fertilizer is the only hazardous material handled recently.

The Seaboard System Railroad disclosed information for the latest year available.

This information, provided in Attachment I, has been provided to CP&L by Seaboard for assisting CP&L in providing to the Nuclear Regulatory Commission (NRC) the necessary information to support the Safety Analysis Review of SHNPP.

This information constitutes confidential and/or proprietary commercial data.

& Light Company requests, pursuant to 10 CFR Section 2.790, that this information supplied by Seaboard be withheld from public disclosure.

The SHNPP is located in a rural community and accordingly shipments of hazardous chemicals which pass within a five mile radius of the plant do not originate or terminate at nearby facilities (Refer to FSAR Section 2.2).

While this lack of local industrialization reduces the frequency and quantity of hazardous chemicals which would otherwise be shipped in the area, it also means that those shipments which do pass within a five mile radius are transient and difficult to identify and analyze.
