Items of Interest Week Ending November 12, 2021 NRC Approves Measurement Uncertainty Recapture Power Uprate at Millstone, Unit 3 On November 9, 2021, the U.S. Nuclear Regulatory Commission (NRC) approved the measurement uncertainty recapture power uprate license amendment request from Dominion Energy Nuclear Connecticut to increase the licensed rated thermal power limit of Millstone Power Station, Unit 3 by approximately 1.6 percent (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21262A001). The NRC staff determined that the licensee could safely increase the reactors heat output, primarily through more accurate means of measuring feedwater flow.

NRC Conducts Public Meeting with NuScale Power, LLC on Operator Training Accreditation Process On November 9, 2021, the staff held a public meeting (ADAMS Accession No. ML21313A179),

to learn about NuScales plan to develop a centralized, vendor-owned, and INPO-accredited training facility. The facility would be a way for future NuScale Combined License applicants and licensees to meet requirements in Title 10 of the Code of Federal Regulations (10 CFR) Part 50 and 10 CFR Part 55 for licensed operator training programs derived from a systems approach to training. In accordance with the NRCs Memorandum of Agreement with the Institute for Nuclear Power Operations (INPO) (ADAMS Accession No. ML20125A374), the staff expects that if NuScale proceeds with this plan, INPO will provide related accreditation documents for NRC staff review.

Office of Nuclear Material Safety and Safeguards (NMSS)

Items of Interest Week Ending November 12, 2021 NMSS Staff Held a Public Meeting on the Regulatory Basis for the Reporting Requirements for Nonemergency Events at Nuclear Power Plants On November 4, 2021, the staff held a public meeting to provide an opportunity to exchange information related to the development of the regulatory basis for the Reporting Requirements for Nonemergency Events at Nuclear Power Plants rulemaking (Docket NRC-2020-0036, RIN 3150-AK71). Approximately 100 stakeholders attended the meeting, including representatives from the nuclear industry, States, nongovernment organizations, and other interested members of the public. The topics of discussion included background information, the status of the rulemaking, the rulemaking process, specific questions posed by the staff, and next steps. The presentations from the meeting can be found in (Agencywide Documents Access and Management System (ADAMS) Accession Nos. ML21295A293 and ML21307A101). The staff is planning a second public meeting on this rulemaking activity for December and anticipates publishing the regulatory basis document for public comment in June 2022.

Risk-Informed, Technology-Inclusive Regulatory Framework for Advanced Reactors -

Availability of Preliminary Proposed Rule Language; Reopening of Comment Period; 10 CFR Part 53 [NRC-2019-0062]; RIN 3150-AK31 On November 8, 2021, the U.S. Nuclear Regulatory Commission (NRC) published a notice in the Federal Register (86 FR 61718), reopening the public comment period for the preliminary proposed rule language for a risk-informed, technology-inclusive framework for reactor licensing. The public comment period closed on November 5, 2021. The NRC has decided to reopen the public comment period until January 31, 2022, to allow more time for members of the public to develop and submit their comments.

NMSS and NRR Staff Participated in EPRI Conference On November 8-11, 2021, NMSS and the Office of Nuclear Reactor Regulation staff participated virtually in a conference on the Electric Power Research Institute (EPRI) Extended Storage Collaboration Program. Participants included representatives from the nuclear industry, national laboratories, universities, the International Atomic Energy Agency, the Organization for Economic Cooperation and Development, Nuclear Energy Agency, as well as international industry participants and regulatory agencies. The staff provided presentations on NRC perspectives, advanced reactor and fuels, and NRC technical activities for storage and transportation that will facilitate planning for storage and transportation reviews and enhances the quality of applications.

NMSS Staff Held a Public Meeting on Tornado Hazards On November 9, 2021, the staff held a hybrid public meeting in the NRC headquarters auditorium to discuss the industrys approaches to addressing tornado hazards during independent spent fuel storage installations short-term operations. In addition, the staff provided an overview of the very low safety significance issue resolution process and how the process may be applied in the inspection and licensing areas (ADAMS Accession Package ML21313A118). Approximately 85 stakeholders participated by webinar and 20 attended in person.

NMSS Staff Approved an Exemption Request from Nuclear Fuel Services, Inc On November 9, 2021, the staff approved the Nuclear Fuel Services, Inc. (NFS), request for an exemption from conducting force-on-force exercises through December 31, 2021, at its fuel fabrication facility located in Erwin, Tennessee (ADAMS Accession No. ML21294A331). NFS requested this exemption because changing local conditions caused by COVID-19 may prevent the licensee from safely conducting the exercises as planned. After December 31, 2021, NFS committed to resuming force-on-force exercises at their regular frequency and communicating with the NRC to reschedule the annual observed exercise on a mutually agreeable date during the first quarter of calendar year 2022.

Controlled Unclassified Information Program, Policy Statement; Issuance; 10 CFR Chapter I [NRC-2021-0204]

On November 12, 2021, the NRC published a notice in the Federal Register (86 FR 62713),

issuing the Statement of Policy to set forth its expectation regarding the treatment of controlled unclassified information (CUI). This final policy statement describes how the NRC will comply with regulations issued by the National Archives and Records Administration (NARA) that direct agencies to minimize the risk of unauthorized disclosure of controlled unclassified information while allowing timely access by authorized holders. This policy statement aligns with similar actions taken by other Federal agencies to communicate changes in agency CUI policy to align with NARA requirements. During the transition to the CUI program, all elements of the NRCs existing Sensitive Unclassified Non-Safeguards Information program will remain in place.
