ORDER (EFFECTIVE IMMEDIATELY) MODIFYING LICENSEThis is to inform the Commission that a Order Modifying License (Order) will be issued on orabout July 27, 2007, to Entergy Nuclear Operations, Inc., for issues related to the Indian Point Nuclear Generating Units 2 and 3 Emergency Notification System (ENS). The Order is being issued to ensure compliance with the regulations and implementation of the requirements of the Energy Policy Act (ACT) of 2005. This Order supplements the requirements of NRC Confirmatory Order (EA-05-190) issued to Indian Point on January 31, 2006, amended by the NRC on January 23, 2007, which extended the implementation date to April 15, 2007. The Confirmatory Order required, in part, a backup power system for the ENS. On April 23, 2007, the NRC issued to Entergy a Notice of Violation (NOV) and Proposed Imposition of Civil Penalty (EA-07-092) for a violation involving the failure to meet the requirements of the Confirmatory Order. On May 23, 2007, Entergy responded to the NOV and described their intended corrective actions and also committed to August 24, 2007, as the latest date anticipated for declaring the new ENS system and its associated backup power supply capability operable. The actions required by this Order include: completing the outstanding requirements delineatedin the January 2006 Confirmatory Order; obtaining FEMA acceptance of the new ENS, as the primary ENS for alerting the public, by August 24, 2007; and, completing the necessary software and procedure use upgrades and training of county personnel responsible for actuation of the system.The requirements of the January 31, 2006, Confirmatory Order remain in effect except asspecifically modified or supplemented by this Order. The NRC staff recognizes that the existing ENS is capable of alerting the general public in the vicinity of the Indian Point station if an emergency condition occurs. However, the existing system does not meet the requirements of the ACT as imposed by the January 31, 2006, Confirmatory Order because it does not have the backup power supply capability. It should be noted that the Entergy has not been specifically informed of the enforcementaction.
