On March 9, 2016, the State of New York filed its Unopposed Motion for Extension of Time to File Reply Expert Testimony, in which the State requested a one week extension of time to accommodate the schedule of its expert witness, Dr. Richard T. Lahey. As conveyed to the Board in t in an unrelated matter for which he could be called to testify on short notice. The State submits this letter to update the Board regarding a development in the schedule for that other proceeding. Yesterday, March 13, Dr. Lahey informed the State that from March 19 through March 24, he expects to be in California for the hearing in that other matter.
