The inspectors identified a noncited viola … The inspectors identified a noncited violation of 10 CFR Part 50, Appendix B, Criterion III, for the failure to assure that applicable regulatory requirements and the design basis were met. Specifically, the licensee failed to ensure that the fuel oil storage tank fill system minimized turbulence, as required by the Updated Safety Analysis Report, such that the emergency diesel generators can be refueled while running uninterrupted. The licensee entered this issue in the corrective action program and will develop corrective actions as part of Condition Report 34730. The failure to establish measures to assure that applicable regulatory requirements and the design basis are met was a performance deficiency. The performance deficiency was more than minor because it impacted the Mitigating Systems Cornerstone attribute of design control and affects the associated cornerstone objective to ensure the availability, reliability, and capability of systems that respond to initiating events to prevent undesirable consequences. Using Inspection Manual Chapter 0609.04, Phase 1 Initial Screening and Characterization of Findings, the inspectors determined that the finding had very low safety significance because it did not result in a loss of system safety function, an actual loss of safety function of a single train for greater than its technical specification allowed outage time, or screen as potentially risk significant due to a seismic, flooding, or severe weather initiating event.
