ALL FEDERALLY RECOGNIZED AMERICAN INDIAN AND ALASKA NATIVE TRIBES OPPORTUNITY TO REQUEST A HEARING AND PETITION FOR LEAVE TO INTERVENE REGARDING THE DISA TEHCNOLOGIES, INC LICENSE APPLICATION (STC-25-028)
Purpose:
To inform all federally recognized Tribes that the U.S. Nuclear Regulatory Commission (NRC) published a Federal Register notice (FRN) on May 12, 2025, affording the opportunity to request a hearing and to petition for leave to intervene regarding the Disa Technologies, Inc. (Disa) license application.
Background:
On October 30, 2024, Disa notified the NRC of its intent to apply for a performance-based, multi-site source materials license to utilize its High-Pressure Slurry Ablation technology to remediate abandoned mine waste at inactive sites. Disa also requested a pre-submission audit of its application and environmental report (Agencywide Documents Access and Management System (ADAMS) Accession No. ML24311A011).
To evaluate readiness, NRC staff conducted a review from January 21 to 24, 2025. The objective was to determine whether the application and environmental report provided sufficient information to meet applicable requirements of Title 10 of the Code of Federal Regulations (10 CFR) Part 20, Standards for Protection against Radiation, Part 40, Domestic Licensing of Source Material, and Part 51, Environmental Protection Regulations for Domestic Licensing and Related Regulatory Functions. Additionally, the assessment sought to identify any missing information necessary for the applicant to submit before the staff could begin its safety and environmental reviews (ADAMS Package Accession No. ML25036A182).
By letter dated March 28, 2025, Disa submitted its application to the NRC (ADAMS Package Accession No. ML25087A094). The NRC staff conducted an acceptance review of the application and concluded that it provided sufficient information to enable the NRC to complete its detailed review (ADAMS Accession No. ML25099A303).
Discussion: The NRC staff expects to complete its safety and environmental reviews by September 30, 2025. This timeline is significantly expedited compared to the typical 12-to 18-month licensing process, due to the pre-application audit and prioritization.
To provide an opportunity for interested parties to request a hearing and petition for leave to intervene, the NRC published a FRN on May 12, 2025 (90 FR 20193). Any requests must be filled by July 11, 2025. Detailed instructions are provided in the FRN.
