July 31, 2025 Week Ending: July 25, 2025 ENCLOSURE C Office of Nuclear Reactor Regulation Items of Interest NRC Public Meeting on Reactor Oversight Process (ROP)
On July 23, 2025, the U.S. Nuclear Regulatory Commission (NRC) staff hosted a public meeting related to the Reactor Oversight Process (ROP) to provide an update on the Agencys actions to date, discuss changes in the implementation plan since the June 5, 2025, meeting, and outline the NRCs plans for revising the ROP Baseline Inspection program to enhance efficiency and resource savings, with a goal to implement changes on January 1, 2026. Attendees included representatives from the Nuclear Energy Institute (NEI), the industry, and members of the public. The next bi-monthly public meeting on ROP-related matters is tentatively scheduled for September 24, 2025; with an additional meeting to discuss the planned revisions to the ROP baseline inspection program tentatively scheduled for August 20, 2025.
NRC Issues Licensing Actions that Reauthorize Power Operations at Palisades Nuclear Plant On July 24, 2025, the NRC issued the bundle of licensing actions that reauthorizes power operations at Palisades Nuclear Plant. Although issued, the exemptions and the license amendments are conditioned such that the plant cannot transition to an operational status before August 25, 2025, the date the licensee provided in its letter dated July 1, 2025. The bundle consists of an Exemption (Agencywide Documents Access and Management System (ADAMS) Accession No. ML25163A182), a License Transfer Application (ML25167A243), the Power Operations Technical Specifications (TS) Amendment (ML25157A127), the Administrative Controls TS Amendment (ML25157A107), the Emergency Plan Amendment (ML25150A281), and the main steam line break (MSLB) Amendment (ML25156A045).
NRC Public Presubmittal Meeting to Discuss Draft Revision E2 of NEI 20-07, Guidance for Addressing Common Cause Failure in High Safety-Significant Safety-Related Digital I&C Systems On July 23, 2025, and July 24, 2025, the NRC staff and NEI held a public presubmittal meeting (ML25188A180) to discuss Draft Revision E2 of NEI 20-07, Guidance for Addressing Common Cause Failure in High Safety-Significant Safety-Related Digital I&C Systems (ML25198A311).
The guidance in NEI 20-07 is intended for developing a defense-in-depth and diversity analysis to address digital common cause failures. NEI used a tabletop example (ML25198A316) (1) to describe how the guidance would be used by applicants and licensees and (2) to illustrate what content that an applicant or licensee would include in an application. Pending issuance by Electric Power Research Institute of updated hazards and consequence analysis in digital systems and digital reliability analysis methodology reports, NEI plans to submit for review and possible endorsement Revision 1 of NEI 20-07 to the NRC in August 2025.
July 31, 2025 Week Ending: July 25, 2025 ENCLOSURE D Office of Nuclear Material Safety and Safeguards Items of Interest Alternative Method for Calculating Embrittlement for Steel Reactor Vessels; Petition for Rulemaking; Denial; 10 CFR Part 50 (PRM-50-120; NRC-2019-0180)
On July 23, 2025, the U.S. Nuclear Regulatory Commission (NRC) published a document in the Federal Register (90 FR 34609) denying a petition for rulemaking, dated August 19, 2019, submitted by Thomas A. Bergman on behalf of NuScale Power, LLC. The petition was docketed by the NRC on September 11, 2019, and was assigned Docket No. PRM-50-120. The petitioner requested that the NRC revise its regulations to add an alternative formula for calculating the mean value of the transition temperature shift described in American Society for Testing and Materials Standard E900-15 to the NRCs regulations and guidance documents. The NRC is denying the petition because the petitioner did not demonstrate the immediacy of any safety issues in the concerns raised in the petition and did not provide any new information that would warrant revision of the NRCs regulations. The docket for the petition for rulemaking, PRM 120, is closed on July 23, 2025.
Public Protective Actions during a General Emergency; Petition for Rulemaking; Consideration in the Rulemaking Process; 10 CFR Part 50 (PRM-50-123; NRC-2020-0155)
On July 21, 2025, the NRC published a document in the Federal Register (90 FR 34190) considering in its rulemaking process issues raised in a petition for rulemaking, PRM-50-123, submitted by Thomas McKenna. The petition, dated June 1, 2020, requested that the NRC amend its regulations to ensure that protective actions in the event of a general emergency will likely do more good than harm. The NRC will evaluate the current requirements and guidance for protective actions implemented during a general emergency at nuclear power plants, assess whether changes are needed to consider risk insights into the health hazards of both radiation exposure and protective actions, and if changes are needed, determine the proper regulatory action. The docket for the petition for rulemaking, PRM-50-123, is closed on July 21, 2025.
