Office of Nuclear Reactor Regulation Items of Interest Week Ending July 26, 2024 Tennessee Valley Authority (TVA) Exemptions from 10 CFR Part 37 On July 15, 2024, the U.S. Nuclear Regulatory Commission (NRC) staff granted Tennessee Valley Authority (TVA) exemptions from the requirement in 10 CFR 37.11(c)(2) to use a locked door or gate with a monitored alarm at the storage facilities where the old Browns Ferry steam dryers and old Sequoyah and Watts Bar steam generators are stored. Although EGM 2014-001 has provided for enforcement discretion on this issue since 10 CFR Part 37 became effective in 2014, TVA sought the exemptions to preclude continual minor violation citations and tracking in condition reports. These are the first operating power plant exemptions that have been granted to resolve issues identified in the EGM.

Technical Review Package (TRP) Tool Utilized by NRC to Increase Efficiency of License Renewal and Subsequent License Renewal Reviews On July 19, 2024, the Technical Review Package (TRP) Tool, an internal software tool that was modernized to increase the efficiency of the staffs review of license renewal and subsequent license renewal applications, went live for staff to utilize. The TRP Tool, revamped by Office of Nuclear Reactor Regulation (NRR) and Office of the Chief Information as described in the License Renewal Roadmap, introduces automatic processing and efficient organization, access, and assignment of review information for project managers and technical reviewers. Training will be provided to the staff and management soon.

Public Meeting with X-energy to Discuss their Geotechnical and Groundwater Investigation Approach On July 23, 2024, the staff held a meeting with X-energy to discuss their geotechnical and groundwater investigation approach that will be used to support the Project Long Mott construction permit application (CPA). X-energy indicated that the CPA submittal will be based on data available at the time of preparation, with plans to later supplement the application with additional data. The NRC staff discussed available guidance for expected content of advanced reactor applications and encouraged further pre-application activities with X-energy and Dow on this and other PSAR-related topics.

Training to U.S. Utility Executives and Japanese Participants on Nuclear Operations Risk Management (NORM)

From July 22-25, 2024, NRR staff provided training to a group of U.S. utility executives and several participants from Japan on nuclear operations risk management (NORM) at the annual Massachusetts Institute of Technology/Institute of Nuclear Power Operations NORM training course. The training provided the NRC staff an opportunity to convey to the participants how the NRC continues to leverage and expand the use of risk information in our licensing and oversight work. The presenters also used this forum to demonstrate how nuclear safety is enhanced by the appropriate application of risk-informed decision-making.

NRC Staff Granted an Exemption Using the Risk Informed Process for Evaluations (RIPE) for Shearon Harris On July 26, 2024, the staff granted an exemption using the Risk Informed Process for Evaluations (RIPE) from a provision in the Institute of Electrical and Electronics Engineers (IEEE) Standard 279-1971 that is required by 10 CFR 50.55a(h)(2) for Shearon Harris.

Specifically, the exemption removes the requirement for certain Reactor Protection System cables that terminate within Turbine Control System Cabinet G to be independent and physically separated in accordance with IEEE 279-1971, Section 4.6. This was NRRs second approval of an exemption request submitted under RIPE.

Public Meeting Related to a Partial Site Release of Property from the Clinton Power Station On July 24, 2024, the staff held a public meeting (required by 10 CFR 50.83(f)) to obtain public comment on Constellations request dated June 7, 2023 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML23158A262), for a partial site release of property from the Clinton Power Station (CPS). Constellation had discovered that the required NRC approval was not obtained prior to the transfer of non-impacted land from the CPS site.

Specifically, on September 17, 2003, a Quit Claim Deed was executed by AmerGen Energy Company, LLC, a previous licensee, to transfer 172.7 acres of land for the Clinton Lake Marina to DeWitt County, Illinois. NRC representatives from NRR, the Office of Nuclear Material Safety and Safeguards, and the Resident Inspector Office were present at the meeting. No members of the public attended the meeting. The Federal Register Notice and the newspaper notice, published associated with the meeting, provided additional methods for public comment. The potential violation will be described in a future NRC inspection report for the site.

Staff Issues North Anna Power Station, Units 1 and 2, Subsequent License Renewal Site Specific Environmental Impact Statement On July 22, 2024, the staff issued NUREG-1437, Generic Environmental Impact Statement for Subsequent License Renewal of Nuclear Plants, Supplement 7a, Regarding North Anna Power Station, Units 1 and 2 (ML24204A104). This site-specific Environmental Impact Statement includes the staff's analysis that considers and weighs the environmental effects of the proposed action, the environmental impacts of alternatives to the proposed action, and mitigative measures available for reducing or avoiding adverse impacts. It also includes the staff's recommendation that the adverse environmental impacts of license renewal for North Anna Power Station are not so great that preserving the option of license renewal for energy planning decision makers would be unreasonable. The U.S. Environmental Protection Agency published the Notice of Availability Federal Register Notice on July 26, 2024 (89 FR 60616),

beginning the 30-day cooling off period before we can issue the renewed license.
