Public Meeting to Discuss American Society of Mechanical Engineers (ASME) Code Case N-883, Construction of Items Prior to the Establishment of a Section III, Division 1, Owner

On May 8, 2024, the staff held a public meeting on American Society of Mechanical Engineers (ASME) Code Case N-883, Construction of Items Prior to the Establishment of a Section III, Division 1, Owner. The purpose of the meeting was to gather comments and views on the industry needs for the code case and to discuss some thoughts that the U.S. Nuclear Regulatory Commission (NRC) was considering for NRC inclusion of Code Case N-883 into Regulatory Guide (RG) 1.84, Design, Fabrication, and Materials Code Case Availability, ASME Section III. While some comments were received, the participants requested another public meeting to provide more time to provide more complete feedback. Another public meeting will be scheduled for early June 2024.

U.S. Nuclear Regulatory Commission (NRC) Approved Exemption Request from Constellation Energy Generation, LLC to Allow Use of MPC-89-CBS Canisters at the Limerick Generating Station Unit 1 and Unit 2 ISFSI

On May 8, 2024, Office of Nuclear Material Safety and Safeguards (NMSS) staff approved an exemption to Constellation Energy Generation, LLC for the Limerick Generating Station (LGS)

Units 1 and 2 independent spent fuel storage installation (ISFSI). LGS has used MPC-89-CBS canisters in storage and plans a future loading of MPC-89-CBS canisters, which does not meet the terms, conditions, and specifications in the certificate of compliance for the HI-STORM FW MPC Storage System. This exemption was issued 12 weeks earlier than the requested date, and it would allow the ongoing storage of three MPC-89-CBS canisters in the HI-STORM FW MPC Storage System and a future loading of five MPC-89-CBS canisters at the LGS ISFSI beginning in August, without restoring compliance. The exemption decision will be published in the Federal Register (Agencywide Documents Access and Management System (ADAMS)

NRC Approved Exemption Request from Vistra Operations Company, LLC to Allow Use of MPC-89-CBS Canisters at the Perry Nuclear Power Plant Unit 1 ISFSI

On May 8, 2024, NMSS staff approved an exemption to Vistra Operations Company, LLC for the Perry Nuclear Power Plant Unit 1 ISFSI. Perry plans a future loading of MPC-89-CBS canisters, which does not meet the terms, conditions, and specifications in the certificate of compliance for the HI-STORM FW Cask System. This exemption was issued 8 weeks earlier than the requested date, and it would allow the future loading of two MPC-89-CBS canisters at Perry ISFSI beginning in August. The exemption decision will be published in the Federal Register (ML24103A117).
