Items of Interest Week Ending MARCH 26, 2021 Westinghouse Submits Information Related to the AP1000 Design Certification Extension On March 19, 2021, Westinghouse Electric Company, LLC submitted a letter to the NRC related to the Advanced Passive 1000 (AP1000) Design Certification (DC) extension (Agencywide Documents Access and Management System Accession No. ML21081A023). The submittal included: (1) the five identified design issues that were corrected based on current Vogtle AP1000 construction, and (2) applicable DC updates associated with those changes. This information is needed by the NRC staff to ensure a complete AP1000 design per Title 10 of the Code of Federal Regulations (10 CFR) 52.54 and in order to proceed with a direct final rule and the five-year DC extension.

Items of Interest Week Ending MARCH 26, 2021 NRC Began Next Phase of COVID-19 Oversight Activities Assessment On March 22, 2021, the working group for Phase B of the COVID-19 Public Health Emergency (PHE) Oversight Activities Assessment had its kickoff meeting. The working group will build on Phase A of the COVID-19 PHE Oversight assessment which was completed in fiscal year 2020.
Phase B will evaluate the various practices, adjustments, processes, and different inspection techniques used to carry out important oversight functions associated with the Nuclear Materials and Waste Safety Programs during the PHE. This working group will provide recommendations based on the lessons learned from implementation of the materials oversight programs during the PHE to enable inspections to become more agile, resilient, and efficient both during future PHEs and when operating under normal circumstances.
NRC Held Quarterly Meeting with the National Nuclear Security Administration On March 23, 2021, the NRC staff held a quarterly meeting with management from the National Nuclear Security Administration (NNSA). The meeting focused on collaboration, communications, and creating active partnerships between NRC and NNSA for continued engagement on issues of mutual interest.
NRC Held Introductory Meeting with USNC-Tech on Regulatory Requirements for Byproduct Material On March 23, 2021, the NRC staff had an introductory meeting with representatives of USNC-Tech, a subsidiary of Ultra Safe Nuclear. USNC-Tech is developing battery technology that will use radioisotopes. The NRC staff provided USNC-Tech with an overview of the licensing requirements for byproduct materials and guidance for sealed source and device evaluations and discussed potential engagement with Agreement States. Future public meetings may be scheduled depending on USNC-Tech plans for licensing requests in NRC jurisdiction.
NRC Staff Presented Type B Packaging Certification Requirements at the National Transportation Stakeholders Forum On March 24, 2021, the NRC staff presented at the National Transportation Stakeholders Forum on Type B Packaging Certification Requirements. The presentation was done remotely. The staff presented an overview of the NRCs 10 CFR Part 71 certification and approval process, including the different types of radioactive materials allowed to be shipped, where in the fuel cycle transportation occurs, how 10 CFR 71 Appendix A helps define package types, and the packaging and transportation regulatory philosophy. This presentation provided the webinar attendees with an overview of the packaging requirements for transporting nuclear materials and helped clarify the NRCs oversight activities.

On March 24, 2021, the NRC published a notice in the Federal Register (86 FR 15563) amending its spent fuel storage regulations by revising the TN Americas LLC Standardized NUHOMS Horizontal Modular Storage System listing within the List of approved spent fuel storage casks to include Renewed Amendment No. 17 to Certificate of Compliance No. 1040.
Because this amendment is subsequent to the renewal of the TN Americas LLC Standardized NUHOMS Horizontal Modular System Certificate of Compliance No. 1004 and, therefore, subject to the Aging Management Program requirements of the renewed certificate, it is referred to as Renewed Amendment No. 17. The companion proposed rule was also published in the Federal Register on March 24, 2021 (86 FR 15624). This direct final rule is effective June 7, 2021.
NRC Conducted Quarterly Fuel Facility Stakeholders Public Meeting On March 24-25, 2021, the NRC staff conducted its quarterly Fuel Facility Stakeholders Public Meeting (formerly known as Cumulative Effects of Regulation meeting) to discuss the status of several regulatory initiatives involving the nuclear fuel cycle industry. The public meeting was attended by the Nuclear Energy Institute, representatives from the nuclear fuel cycle industry, and members of the public. Topics discussed during the meeting included updates on: the status of Accident Tolerant Fuel and Advanced Reactor activities; the status of the Smarter Licensing Program; COVID-19 Lessons Learned and oversight activities assessment; the status of the Fuel Cycle Smarter Inspection Program; the Fuel Cycle Operating Experience Program; safety margin; non-fee billable activities; issues of low safety significance; and security for fuel facilities possessing Category II Special Nuclear Material.
American Society of Mechanical Engineers 2019-2020 Code Editions: Proposed Rule; 10 CFR Part 50 (NRC-2018-0290; RIN 3150-AK22)
On March 26, 2021, the NRC published a notice in the Federal Register (86 FR 16087) proposing to amend its regulations to incorporate by reference the 2019 Edition of the American Society of Mechanical Engineers (ASME) Boiler and Pressure Vessel Code and the 2020 Edition of the ASME Operation and Maintenance of Nuclear Power Plants, Division 1: OM Code:
Section IST, for nuclear power plants. The NRC is also proposing to incorporate by reference the 2011 Addenda to ASME NQA-1-2008, Quality Assurance Requirements for Nuclear Facility Applications (ASME NQA-1b-2011), and the 2012 and 2015 Editions of ASME NQA-1, Quality Assurance Requirements for Nuclear Facility Applications. This action is in accordance with the NRCs policy to periodically update the regulations to incorporate by reference new editions of the ASME Codes and is intended to maintain the safety of nuclear power plants and to make NRC activities more effective and efficient. Comments are requested by May 25, 2021.
