Items of Interest Week Ending MARCH 19, 2021 NRC Hosted Meeting on Higher Burnup Advanced Boiling Water Reactor Fuels On March 18, 2021, NRC held a partially closed meeting with Global Nuclear Fuels (GNF) to discuss their plans for higher burnup advanced Boiling Water Reactor (BWR) fuels, as part of the Accident Tolerant Fuel program (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21064A228). The topics discussed included risk-informed approach, submittal and approval strategy, and risk assessments for specific impacted analyses regarding GNF's planned higher burnup extension topical report submission. GNF and the NRC staff plan to have a follow-up meeting to complete the discussion on risk assessments for specific impacted analyses and high burnup core designs. A publicly available meeting summary is available in ADAMS at Accession No. ML21081A200.

Staff Approved Licensing Requests for Regulatory Relief Related to the COVID-19 Public Health Emergency The NRC staff has reviewed and approved several licensing requests seeking temporary flexibilities to maintain the safe and secure operation of the U.S. nuclear fleet during the pandemic. A summary of approved licensing actions provided during this reporting period are summarized below. Regulatory Basis; Request for Comment; Extension of Comment Period; 10 CFR Parts 2, 21, 26, 50, 51, 52, 55, and 73 (NRC-2009-0196; RIN 3150-AI66]

On March 18, 2021, the NRC published a notice in the Federal Register (86 FR 14695) extending the comment period for a notice published on January 29, 2021, which requested public comment on a regulatory basis to support a proposed rule that would amend the NRC's regulations for the licensing of new nuclear power reactors. The public comment period was originally scheduled to close on April 14, 2021. The NRC has decided to extend the public comment period to allow more time for members of the public to develop and submit their comments. The due date of comments requested in the document published on January 29, 2021 (86 FR 7513), is extended. Comments should be filed no later than May 14, 2021.

Enhancing Participation in NRC Public Meetings: Revision to Policy Statement; Issuance (NRC-2016-0178)

On March 19, 2021, the NRC published a notice in the Federal Register (86 FR 14964) revising its policy statement, Enhancing Participation in NRC Public Meetings. The revised policy statement redefines the three categories of public meetings and identifies the level of public participation offered at each category of meeting. The revised policy statement also clarifies notification expectations for meetings that include physical presence in the meeting room and meetings that rely solely on remote access technology such as teleconferencing. The revisions will improve the consistency of the NRC's public meetings and help participants better prepare for NRC meetings. This policy statement is effective on March 19, 2021.

Office of Nuclear Security and Incident Response (NSIR)

Items of Interest Week Ending MARCH 19, 2021 NRC Participated in Transportation Security Webinar On March 17, 2021, the NRC staff participated in the sixth Radiant Response webinar. Radiant Response is a virtual radiological transportation incident awareness series, sponsored by the Department of Energy (DOE) and the Federal Bureau of Investigation, that poses scenarios involving the theft/diversion of Category 1 or 2 radioactive materials for malicious purposes.

The exercises promote information sharing, discussion of response capabilities, problem resolution, and consequence management among Federal, State and local emergency response personnel. NRC staff presented information on the agency's mission and clarified the NRCs roles and responsibilities.

NRC Participated in Cyber Security Meeting On March 17, 2021, the NRC staff participated in a meeting of the Securing Energy Infrastructure Task Force (TF) Senior Technical Group (STG), led by DOEs Office of Cybersecurity, Energy Security, and Emergency Response. Members of the STG represent government organizations, utilities, academia, and national laboratories. The TFs Congressionally-mandated mission is to advise a two-year pilot program to isolate and defend critical industrial control systems from security vulnerabilities and exploits. The meeting included updates on the TFs efforts along with major milestones in support of developing the final report to Congress in June 2022.

NRC Discussed Security for High-Assay Low-Enriched Uranium Fuel On March 17, 2021, the NRC staff participated in a teleconference with Brookhaven National Laboratory (BNL) staff who are examining physical protection implications of the use of High-Assay Low-Enriched Uranium fuel at reactor sites. Participants discussed the DOE-funded effort to understand the potential Category II special nuclear material security requirements beyond those in 10 CFR Part 73.67 that an NRC licensee could expect for physical protection of fresh fuel. NRC and BNL staff plan to maintain communications to support the development of the project.
