Items of Interest Week Ending OCTOBER 02, 2020 Staff Received Licensing Topical Report Regarding BWRX-300 Design On September 25, 2020, the NRR staff received the next in a series of anticipated licensing topical reports (LTRs) from GE-Hitachi Nuclear Energy Americas, LLC (GEH), for their BWRX-300 design as part of their pre-application activities. This new LTR, entitled Containment Evaluation Method Licensing (Agencywide Documents Access and Management System (ADAMS) Package Accession No. ML20269A469), presents the analysis method used for the BWRX-300 containment thermal hydraulics performance for U.S. Nuclear Regulatory Commission (NRC) review and approval. The staff will review this LTR and associated technical information and will draw conclusions regarding the acceptability of the method; as well as ensuring that the LTR is acceptable for use during GEHs future licensing activities in accordance with Title 10 of the Code of Federal Regulations (10 CFR) Part 50, or 10 CFR Part 52, as applicable.
Staff Hosted Public Meeting Regarding Pre-Application Engagement Related to the Holtec Small Modular Reactor SMR-160 On September 30, 2020, the NRR staff held a public meeting with SMR, LLC (a Holtec International Company) (Holtec) to discuss pre-application engagement matters related to the Holtec small modular reactor SMR-160 (ADAMS Accession No. ML20274A008). During the meeting, Holtec provided the NRC staff with an overview of Holtecs company structure, as well as with a technology overview of their SMR-160 design (ADAMS Accession No. ML20271A004). This meeting was scheduled as the first in a series of pre-application discussions following Holtecs July 9, 2020, letter request to the NRC regarding pre-application licensing engagements to develop a mutually agreeable regulatory engagement plan (ADAMS Accession No. ML20191A228).
Staff Hosted Public Meeting Regarding Regulatory Improvements to Support the Licensing of Advanced Reactors On October 1, 2020, the NRC staff held a public webinar with over 150 stakeholders on regulatory improvements to support the licensing of advanced reactors (ADAMS Accession No. ML20274A091). Topics included analysis of applicability of NRC regulations for non-light-water reactors, an update on the advanced reactor generic environmental impact statement, advanced reactor fuel qualification, MACCS code applicability for nearfield consequence analysis, and molten salt non-power reactor application guidance. This meeting was in support of Strategy 2 (computer codes), Strategy 3 (regulatory framework), and Strategy 5 (resolution of policy issues) of the advanced reactor Implementation Action Plans (ADAMS Accession Nos.
ML17165A069 and ML17164A173).

Staff Approved Licensing Requests for Regulatory Relief Related to the COVID-19 Public Health Emergency The NRC staff has reviewed and approved several licensing requests seeking temporary flexibilities to maintain the safe and secure operation of the U.S. nuclear fleet during the pandemic. A summary of approved licensing actions provided during this reporting period is summarized below. Items of Interest Week Ending OCTOBER 02, 2020 Reactor Vessel Material Surveillance Program: Direct Final Rule; Part 50 of Title 10 of the Code of Federal Regulations (10 CFR) (Regulatory Identifier Number 3150-AK07; NRC-2017-0151)
On October 2, 2020, the U.S. Nuclear Regulatory Commission (NRC) published a notice in the Federal Register (85 FR 62199) amending the reactor vessel material surveillance program requirements for commercial light-water power reactors. This direct final rule revises the requirements associated with the testing of specimens contained within surveillance capsules and reporting the surveillance test results. This direct final rule also clarifies the requirements for the design of surveillance programs and the capsule-withdrawal schedules for surveillance capsules in reactor vessels purchased after 1982. These changes reduce regulatory burden, with no effect on public health and safety. The companion proposed rule was also published in the Federal Register (85 FR 62234) on October 2, 2020. This direct final rule is effective February 1, 2021.
Instructions for Completing NRCs Uniform Low-Level Radioactive Waste Manifest:
NUREG; Clarification; 10 CFR Part 20 (NRC-2018-0155)
On September 30, 2020, the NRC published a notice in the Federal Register (85 FR 61576) announcing the delay of the use of NUREG/BR-0204, Revision 3, Instructions for Completing NRCs Uniform Low-Level Radioactive Waste Manifest, which was completed in June 2020.
This document provides instructions to prepare three manifest forms: NRC Form 540 (Shipping Paper), NRC Form 541 (Container and Waste Description) and NRC Form 542 (Manifest Index and Regional Compact Tabulation). Until further notice, licensees should continue to use NUREG/BR-0204, Revision 2 and the versions of NRC Forms 540, 541 and 542 that were renewed in January 2020, or equivalent, as defined in NRC's regulations.
Guidance for Implementation of Changes, Tests, and Experiments: Regulatory Guide; Issuance; 10 CFR Part 72 (NRC-2020-0059)
On September 28, 2020, the NRC published a notice in the Federal Register (85 FR 60691) issuing Revision 1 to Regulatory Guide (RG) 3.72, Guidance for Implementation of Changes, Tests, and Experiments. Revision 1 to RG 3.72 endorses Nuclear Energy Institute 12-04, Revision 2, which updates and revises previous guidance to incorporate operating experience and NRCs inspection findings. In addition, RG 3.72, Revision 1, changes the NRCs guidance on departures from a method of evaluation (MOE) and the NRCs approval of an MOE.
NMSS Staff Hold Public Webinar on Reactor Decommissioning On September 24, 2020, staff from NMSS and Region III held a public webinar on the reactor decommissioning process, including information on the Post Shutdown Decommissioning Activities Report for the Duane Arnold Energy Center, which permanently ceased power operations in August 2020. There were 45 attendees. At the end of the presentation, participants had an opportunity to make comments and ask the staff questions.

NMSS Staff Issue Scoping Summary Report On September 25, 2020, the NMSS staff issued the Scoping Summary Report for the Advanced Reactor Generic Environmental Impact Statement (ADAMS Accession No. ML20260H180).
During the public comment period for the report, the staff received approximately 3200 comment letters. The staff identified approximately 300 unique comments which were summarized and addressed in the final report. The staff discussed its results with stakeholders at the monthly advanced reactor stakeholder public meeting on October 1, 2020.
NMSS and Region 1 Host Government-to-Government Meeting On October 1, 2020, staff from NMSS and Region I held a government-to-government meeting at the request of the Pennsylvania Department of Environmental Protection (PADEP) to discuss decommissioning activities and the Three Mile Island Unit 2 license transfer application.
PADEP and NRC committed to continue regulatory cooperation and transparency with the public.
NMSS Staff Hold Public Meeting on Proposed Consolidated Interim Storage Facility On October 1, 2020, the NRC staff held a public meeting via webinar and teleconference on the draft environmental impact statement for the Interim Storage Partners proposed consolidated interim storage facility in Andrews County, Texas. The public meeting lasted 3.5 hours5.787037e-5 days <br />0.00139 hours <br />8.267196e-6 weeks <br />1.9025e-6 months <br /> and approximately 187 individuals participated with 34 people providing verbal comments. The NRC will hold three more public meetings to gather comments, with the next planned for October 6, 2020. The public comment period ends November 3, 2020.
