Items of Interest Week Ending SEPTEMBER 27, 2019 Public Meeting to Discuss Draft Regulatory Guide (RG) 1.187, "Guidance for Implementation of 10 CFR 50.59, Changes, Tests, and Experiments," Revision 2 On September 18, 2019, the staff held a public meeting with the Nuclear Energy Institute (NEI) to obtain clarification on comments submitted during the public comment period on draft Regulatory Guide (RG) 1.187, Guidance for Implementation of 10 CFR 50.59, "Changes, Tests, and Experiments," Revision 2 (ADAMS Accession No. ML19045A435). The comments focused on NEI 96-07, Appendix D, Supplemental Guidance for Application of 10 CFR 50.59 to Digital Modifications, Section 4.3.6, where the staff has taken an exception in its draft endorsement (ADAMS Accession No. ML19198A323). Specifically, the staff is taking exception to the new guidance that would have licensees restrict the evaluation of a malfunction and results to the term "safety analyses" instead of the "FSAR, as updated." By September 27, NEI will provide the staff with their next steps to address any exception remaining in draft RG 1.187, Revision 2.

It is anticipated that NEI will revise the wording in NEI 96-07, Appendix D, Section 4.3.6. Once a new revision of Appendix D is submitted, draft RG 1.187, Revision 2, will be revised and issued for an additional public comment period .

Vogtle Electric Generating Plant Unit 3 - Proficiency Watches Prior to Fuel Load On September 19, 2019, the staff issued a letter (ADAMS Accession No. ML19261A070) to Southern Nuclear Operating Company (SNC) stating the staff agrees that SNC's proposal, detailed in its July 2, 2019, letter (ADAMS Accession No. ML19235A016) is an acceptable approach to maintaining active licenses for reactor operators and senior reactor operators during the period when operator licenses are issued before initial fuel load. This action will enable operators qualifying on AP1000 to maintain proficiency prior to fuel load .

Duke Energy Will Seek Subsequent License Renewal for the 11 Reactors It Operates On September 24, 2019, Duke Energy submitted a letter of intent to notify the NRC of its intent to submit by the end of 2021 a subsequent license renewal application for Oconee Units 1, 2, and 3. As previously announced, Duke intends to seek subsequent license renewal for its entire fleet. The renewed operating licenses for Oconee Units 1, 2, and 3 were issued on May 23, 2000, and will expire on February 6, 2033, October 6, 2033, and July 19, 2034, respectively.
