PROCEEDINGS CHAIRMAN SVINICKI: Good afternoon. I call the Commissions affirmation session to order. Madame Secretary, I believe we have two items for the Commission to affirm today.

Would you please lead us through?

ANNETTE VIETTI-COOK: Yes, the first item is on SECY-19-0093, Tennessee Valley Authority (Clinch River Nuclear Site Early Site Permit Application), Mandatory Hearing Decision.

The Commission is being asked to act on a Memorandum and Order addressing the required findings of 10 C.F.R. §§ 52.24(a) and 51.105(a) and the issues discussed at the uncontested hearing concerning the application of the Tennessee Valley Authority for an early site permit for the Clinch River Nuclear Site in Roane County, Tennessee.

The Commission (with Commissioner Baran dissenting in part) has voted to approve a Memorandum and Order (as attached) that authorizes issuance of the early site permit.

COMMISSIONER BARAN: Aye.

COMMISSIONER CAPUTO: Aye.

COMMISSIONER WRIGHT: Aye.

ANNETTE VIETTI-COOK: The second item is SECY-19-0105, Entergy Nuclear Operations, Inc., Entergy Nuclear Generation Co., Holtec International, and Holtec Decommissioning International, LLC (Pilgrim Nuclear Power Station), License transfer.

4 The Commission is being asked to act on a Memorandum and Order responding to requests by the Commonwealth of Massachusetts and Pilgrim Watch to stay the effectiveness of (1) the staffs Order approving the transfer of the Pilgrim renewed facility operating license and the general license for the Independent Spent Fuel Storage Installation; (2) a related exemption issued by the staff to Holtec Pilgrim, LLC, and Holtec Decommissioning International, LLC; and (3) an associated license amendment issued on August 27, 2019.

The Commission has voted to approve a Memorandum and Order denying the requests.
