Items of Interest Week Ending JUNE 14, 2019 On May 8, 2019, the Executive Director for Operations (EDO) issued a decision on the appeal of DPO 2017-009 concerning the very low safety significance (GREEN) characterization of an NRC Region IV inspection finding associated with a 2016 loss of decay heat removal event at the Grand Gulf Nuclear Station (documented in Special Inspection Report 05000416/2016008).
The DPO specifically asserted that the staff should have performed a qualitative risk assessment of the inspection finding given substantial evidence of programmatic failures at Grand Gulf, particularly with respect to human performance in the operations department. The EDO's decision was based, in part, on a detailed independent assessment of the matter led by the Director of the Office of Nuclear Regulation (NRR) , and ultimately supported both the DPO ad-hoc review panel's independent technical conclusions and the Regional Administrator's decision . In the decision memorandum, the EDO noted that NRR's ongoing Reactor Oversight Process (ROP) "Enhancement Project" would be examining the identification and treatment of licensee programmatic weaknesses as part of an effectiveness review of the ROP's cross-cutting issues program. The DPO ad-hoc review panel concluded that the inspection finding was best characterized as Green, that adequate risk tools existed to complete the significance determination, that proper risk metrics were used, and that the Qualitative Health Objectives were addressed. The EDO also acknowledged that the initial decision regarding the DPO submittal was not timely, and that the Office of Enforcement would be tasked to improve participant accountability related to timeliness and communication throughout the various stages within the DPO program. Items of Interest Week Ending JUNE 14, 2019 Meeting with Global Nuclear Fuels to Discuss Near-Term Accident Tolerant Fuel Concept On June 5, 2019, the staff met with Global Nuclear Fuels (GNF) to discuss their near-term accident tolerant fuel (ATF) concept ARMOR coated cladding and their high-level plans for burnup and enrichment extension. This productive engagement, consistent with the ATF project plan, was part of quarterly workshops held between GNF and the staff to engage on technical and regulatory issues earlier, and often, to enable timely licensing reviews. The meeting focused on current and planned lead test assembly (LTA) programs, an update on testing activities, production process and readiness, initial analysis of the impacts of the coated cladding phenomena identification and ranking table (PIRT) outcomes on ARMOR, strategy for LOCA modeling, and an assessment and initial timeline for burnup and enrichment extension .

Items of Interest Week Ending JUNE 14, 2019 Nuclear Power Plant License Fees Upon Commencing Commercial Operation: Petition for Rulemaking: Notice of Docketing and Request for Comment: 10 CFR Part 171 (NRC-2019-0084: PRM-171-1)
On June 10, 2019, the NRC published in the Federal Register(84 FR 26774) a notice of docketing and request for comment for a PRM received from Michael D. Meier on behalf of Southern Nuclear Operating Company, dated February 28, 2019, requesting that the NRC revise its regulations related to the start of assessment of annual fees for certain nuclear power plants to align with commencement of their commercial operation . The petition was docketed by the NRC on March 21, 2019, and has been assigned Docket No. PRM-171-1 . The NRC is examining the issues raised in PRM-171-1 to determine whether they should be considered in rulemaking. The NRC is requesting public comment on this petition . Comments are requested by July rn, 2019.
Access to the Decommissioning Trust Fund for the Disposal of Large Components:

On June 12, 2019, the NRC published in the Federal Register (84 FR 27209) a notice of docketing and request for comment for a petition for rulemaking (PRM) received from Gerard P.
Van Noordennen, dated February 22, 2019, on behalf of EnergySolutions, LLC. The petitioner requests that the NRC revise its regulations to allow access to the decommissioning trust fund for the removal of major radioactive components before the permanent cessation of operations.
The petition was docketed by the NRC on March 20, 2019, and has been assigned Docket No.
PRM-50-119. The NRC is examining the issues raised in PRM-50-119 to determine whether they should be considered in rulemaking . The NRC is requesting public comment on this petition. Comments are requested by August 26, 2019.
