Items of Interest Week Ending May 4, 2018 Modified Small Quantities Protocol: Final Rule; Part 75 of Title 10 of the Code of Federal Regulations (10 CFR) (Regulatory Identifier Number 3150-AJ70; NRC-2015-0263)
On May 4, 2018, the NRC published a final rule in the Federal Register (83 FR 19603) amending its regulations to collect information on nuclear material possessed by entities in the U.S. Caribbean Territories, as well as to allow for International Atomic Energy Agency (IAEA) inspection access, if requested by the IAEA. This final rule implements the requirements of The Agreement between the United States of America and the IAEA for the application of safeguards in connection with the Treaty for the Prohibition of Nuclear Weapons in Latin America, that apply to the United States based on modifications to this Agreements small quantities protocol. This final rule is effective June 4, 2018.
Review of Administrative Rules; Chapter 1 of 10 CFR; Request for Comment (NRC-2017-0214)
On May 3, 2018, the NRC published a document in the Federal Register (83 FR 19464) initiating a retrospective review of administrative requirements to identify outdated or duplicative administrative requirements that may be eliminated without an adverse effect on public health or safety, common defense and security, protection of the environment, or regulatory efficiency and effectiveness. The NRC is providing an outline of its strategy and is seeking public comment on the criteria that the NRC proposes to use to identify administrative regulations for possible elimination. This retrospective review of administrative regulations will complement the NRCs existing strategy for retrospective analysis of existing regulations. Comments are due by July 2, 2018.

Items of Interest Week Ending May 4, 2018 International Atomic Energy Agency Meeting on Research Reactors From April 23 - 27, 2018, the staff participated in a consultancy meeting with the International Atomic Energy Agency and other State members in Vienna, Austria, to revise international safety guides for research reactors. Specific topics covered included commissioning, core management, management systems, training, radiation protection, waste, and fuel handling for research reactors. The meeting also covered the introduction of new guidance for subcritical assemblies. The staff provided its technical expertise; suggested document revisions; shared lessons-learned from licensing and oversight experience; and ensured consistency between NRC and international guidance.
Open Phase Condition License Amendment On May 3, 2018, the staff approved technical specification licensee amendments for Virginia Electric Power Companys (Dominion Energy) Surry Power Station, Units 1 and 2, to support plant modifications to install Class 1E negative sequence voltage (open phase) protective circuity. The amendments are in response to NRC Bulletin 12-01, Design Vulnerability in Electric Power System. This is one of the first NRC approvals of a plant-specific Class 1E solution for the open phase condition issue.
