Items of Interest Week Ending January 12, 2018 Adjustment of Civil Penalties for Inflation for Fiscal Year 2018; Final Rule; Parts 2 and 13 of Title 10 of the Code of Federal Regulations (10 CFR) (Regulation Identifier Number 3150-AJ83; NRC-2016-0138)

On January 12, 2018, the NRC published a final rule in the Federal Register (83 FR 1515) amending its regulations to adjust the maximum Civil Monetary Penalties (CMPs) it can assess under statutes enforced by the agency. These changes are mandated by the Federal Civil Penalties Inflation Adjustment Act of 1990, as amended by the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015. The NRC is amending its regulations to adjust the maximum CMP for a violation of the Atomic Energy Act of 1954, as amended (AEA), or any regulation or order issued under the AEA, from $285,057 to $290,875 per violation, per day.

Additionally, the NRC is amending provisions concerning program fraud civil penalties by adjusting the maximum CMP under the Program Fraud Civil Remedies Act from $10,957 to

$11,181 for each false claim or statement. This final rule was effective on January 15, 2018.

Unified Agenda of Federal Regulatory and Deregulatory Actions; Semiannual Regulatory Agenda; 10 CFR Chapter I; (NRC-2017-0185)

On January 12, 2018, the NRC published a notice in the Federal Register (83 FR 2017) providing NRCs semiannual regulatory agenda (the Agenda) in accordance with Public Law 96-354, The Regulatory Flexibility Act, and Executive Order 12866, Regulatory Planning and Review. The Agenda is a compilation of all rulemaking activities on which the NRC has recently completed action, has proposed, or is considering action. Comments on the Agenda should be submitted by February 12, 2018.
