WITHDRAWAL OF ADMINSTRATIVE LETTER 93-01

ADDRESSEES

All holders of and applicants for construction permits or operating licenses for nuclear power reactors under the provisions of Title 10 of the Code of Federal Regulations (10 CFR) Part 50,

Domestic Licensing of Production and Utilization Facilities.

All holders of licenses for power reactors who have certified under 10 CFR 50.82, Termination of license that they have permanently ceased operations and permanently removed fuel from the reactor vessel.

All holders of, and applicants for, a construction permit or an operating license for non-power reactors (research reactor, test reactor, or critical assembly reactor) under 10 CFR Part 50.

All holders of licenses for non-power reactors who permanently ceased operations and permanently removed fuel from the reactor.

All holders of and applicants for a combined license, standard design approval, or manufacturing license under 10 CFR Part 52, Licenses, Certifications, and Approvals for Nuclear Power Reactors. All applicants for a standard design certification, including such applicants after initial issuance of a design certification rule.

All materials licensees. All Radiation Control Program Directors and State Liaison Officers.

INTENT

The U.S. Nuclear Regulatory Commission (NRC) is issuing this regulatory issue summary (RIS)

to inform addressees that the NRC is withdrawing Administrative Letter (AL) 93-01. This RIS

requires no action or written response on the part of an addressee.

BACKGROUND INFORMATION

In 1993, the NRC began issuing a new type of generic communication called an administrative letter. The first AL that was issued by NRC was AL 93-01, Announcing a New Type of NRC

Generic Communication. AL 93-01 was itself used to explain the purpose and function of administrative letters. As explained in AL 93-01, the purpose and function of administrative ML14262A350 letters is to inform addressees of administrative procedure changes as well as other issues of a strictly administrative nature.

SUMMARY OF ISSUE

In SECY 99-143, "Revisions to the Generic Communications Program," dated May 26, 1999, the staff provided the Commission with an evaluation of the generic communications program.

In the SECY, the staff noted that the function of administrative letters would be incorporated into the (then) new generic communication product called the regulatory issue summary (RIS). The agency also announced this transfer of functions in RIS 99-001, Revisions to the Generic Communications Program. In 1997, the NRC discontinued issuing administrative letters.

This RIS withdraws AL 93-01. The withdrawal of this AL does not affect the ongoing effectiveness of other previously issued ALs.

BACKFITTING AND ISSUE FINALITY DISCUSSION

This RIS advises addressees of the NRCs decision to end the use of administrative letters to inform relevant external stakeholders of administrative procedure changes as well as other issues of a strictly administrative nature. The NRCs methods of communicating such non- binding information to affected stakeholders is not the kind of agency action which is within the purview of the NRCs backfitting and issue finality provisions in 10 CFR Chapter I.

FEDERAL REGISTER NOTIFICATION

A notice of opportunity for public comment on this RIS was not published in the Federal Register because it is informational, and pertains to a staff administrative practice for communicating non-binding information of a strictly administrative nature to relevant external stakeholders. The staff does not believe that providing an opportunity for public comment would result in significant comments, or that providing the opportunity would be perceived as a positive step in public transparency and involvement by external stakeholders. Accordingly, the staff decided not to provide an opportunity for public comment on a draft of this RIS

CONGRESSIONAL REVIEW ACT

The NRC has determined that this RIS is not a rule as designated by the Congressional Review Act (5 U.S.C. 801-808) and, therefore, is not subject to the Act.

PAPERWORK REDUCTION ACT STATEMENT

This RIS does not contain any information collection requirements, and therefore, is not subject to the requirements of the Paperwork Reduction Act of 1995 (44 U.S.C. 3501 et seq.).

Public Protection Notification The NRC may not conduct or sponsor, and a person is not required to respond to, a request for information or an information collection requirement unless the requesting document displays a currently valid OMB control number.
