INTENT
TheU.S.NuclearRegulatoryCommission(NRC)isissuingthisregulatoryissuesummary(RIS)toclarifythereportingrequirementsof10CFR50.75(f)(1)regardingthestatusof decommissioningfunding.Licenseessubmittingfinancialreportspursuanttotherequirements of10CFR50.75(f)(1)(duebyMarch31,2001)areexpectedtoseparatefundingestimates relatedtothecostsofdecommissioningincludedintheNRC'sdefinitionofdecommissioningin
10CFR50.2,fromthoserelatedtootherdecommissioningcostsnotsoincluded.
BACKGROUND
INFORMATIONPursuantto10CFR50.75(f)(1),powerreactorlicenseesarerequiredtoreportthefinancialstatusofdecommissioningfundstotheNRCeverytwoyears,withthefirstreportsbeing submittedbyMarch31,1999.TheinformationintheMarch31,1999reportsincluded:(1)theamountofdecommissioningfundsestimatedtoberequiredpursuantto10CFR50.75(b)and(c)(2)theamountaccumulatedtotheendofthecalendaryearprecedingthedateofthereport(December31,1998)(3)ascheduleoftheannualamountsremainingtobecollected
(4)theassumptionsusedindeterminingratesofescalationindecommissioningcosts,ratesofearningsondecommissioningfunds,andratesofotherfactorsusedinfunding projections(5)anycontractsuponwhichthelicenseeisrelyingpursuantto10CFR50.75(e)(1)(v)

Licenseesaretoestimatethefundingneededforradiologicaldecommissioningeitherbyusingtheformulasincludedin10CFR50.75(c)orbyusingasite-specificmethodology.Thesite- specificdecommissioningestimatecannotbelowerthanthedecommissioningestimateusing the10CFR50.75(c)formulas.AccordingtoNUREG-1577,Revision1,"StandardReviewPlan onPowerReactorLicenseeFinancialQualificationsandDecommissioningFundingAssurance"
(SRP),theNRCformulasin10CFR50.75(c)includeonlydecommissioningcostsincurredby licenseestoremoveafacilityorsitesafelyfromserviceandreduceresidualradioactivitytoa levelthatpermits(1)releaseofthepropertyforunrestricteduseandterminationofthelicense, or(2)releaseofthepropertyunderrestrictedconditionsandterminationofthelicense.The formulasdonotincludethecostsofdismantlingnon-radiologicalsystemsandstructuresorthe costsofmanagingandstoringspentfuelonsite.Therefore,theSRPstatesthatlicensees shouldeitheromitthesecostsintheircalculationsorlistthemseparately.TheNRCstaff compilesthisinformationtoassisttheCommissioninassessingthestatusofdecommissioning fundingassurance.In1999,somelicenseesreportingunder10CFR50.75(f)indicateda combinedtotalanddidnotdistinguishbetweentheradiologicalandnon-radiologicalestimates.
ThestaffisissuingthisRIStoinformlicenseesoftheneedtopreservethedistinctionbetween NRC-definedcostestimatesandallotherdecommissioningcostestimatesinthereportsthey mustsubmitbyMarch31,2001.SUMMARYOFISSUEInreportingthefinancialstatusofdecommissioningfunds,licenseesshouldeitheromitorlistseparately,thecostsofnonNRC-defineddecommissioningactivities,suchasdismantlingnon- radiologicalsystemsandstructuresandthecostsofmanagingandstoringspentfuelonsite.
Thesenon-radiologicalcostsarenotcountedaspartofNRC'srequireddecommissioning fundingassurance.BACKFITDISCUSSIONThisRISrequiresnoactionorwrittenresponseandis,therefore,notabackfitunder10CFR50.109.Consequently,thestaffdidnotperformabackfitanalysis.FEDERALREGISTERNOTIFICATIONAnoticeofopportunityforpubliccommentwasnotpublishedintheFederalRegister becausethisRISisinformationalandpertainstoamatterthatwasopentopubliccommentduringits promulgation.
