Dear Mr. Cecil:
I am responding to your letter to Representative John Miller of November 25, 1991, requesting assistance in obtaining information regarding the operation of the Duke Power Company's (DPC) nuclear stations. You requested information on the number of warnings, issues, or findings for which DPC has been cited in the last 18 months. You also expressed interest in the number of these issues for which DPC is overdue in taking corrective action, and how DPC compares to the rest of the nuclear industry in this area. Your letter was forwarded to my office for direct response to you.
A member of my staff has discussed these issues with you. You indicated that a news report concerning a recent problem at a DPC nuclear station noted that the NRC had issued "numerous warnings" to DPC. While it is unclear what the news report meant by "warnings," license holders for nuclear power plants are cited for violations of regulatory requirements when identified or confirmed by U.S. Nuclear Regulatory Commission (NRC) inspectors. These violations can range from issues of serious regulatory concern to those of only minor safety concern. The NRC tracks these violations and publishes a compilation of the most serious ones in the quarterly NRC report NUREG-0940, "Enforcement Actions:
Significant Actions Resolved," which is available to the public.
In the last 18 months, the three DPC nuclear stations, consisting of seven individual units, have been cited six times for significant violations.
Copies of NUREG-0940 issued since July 1990 and of the six enforcement actions are enclosed for your information.
We do not calculate or track the average number of violations for each operating nuclear station. However, the DPC nuclear stations have had a high number of significant violations, and the NRC is closely monitoring DPC's performance. None of the DPC nuclear stations have unresolved corrective actions resulting from enforcement actions which are overdue. The last enforcement action issued to DPC on February 3, 1992, requires a response by March 4, 1992. Mr. William Cecil
- 2 the Catawba station. A decision on that matter is expected shortly. The adequacy of the responses for those actions will be reviewed by the NRC to determine whether any additional NRC enforcement action is necessary to assure compliance with NRC regulatory requirements.
