Via Reference ( I ) FPL Energy Point Beach, LLC (FPLE-PB) submitted a proposed license amendment request for Commission review and approval pursuant to 10 CFR 50.90 for the Point Beach Nuclear Plant (PBNP), Units 1 and 2. The proposed amendment would adopt the alternative source term (AST) as described in 10 CFR 50.67 following the guidance provided in Regulatory Guide (RG) 1. I 83, "Alternative Radiological Source Terms for Evaluating Design Basis Accidents at Nuclear Power Reactors."

Subsequent to submittal of the application, FPLE-PB identified concerns with the proposed modifications. FPLE-PB discussed these concerns with the NRC Project Manager on January 14,2008.

Accordingly, FPLE-PB has decided to withdraw this proposed license amendment. FPLE-PB intends to resubmit this license amendment request in its entirety by the end of 1Q09. The analysis will include the planned 17% power uprate.

In Reference (2), NMC committed to "submit a license amendment request to the NRC revising the current accident analysis for PBNP to demonstrate compliance with the dose limits of 10 CFR 50, Appendix A, GDC-19, using the Alternative Source Term by October I , 2007. As part of this submittal, the post-accident reliance on KI for control room staff will be addressed."

This commitment will be revised.

Document Control Desk Page 2 In Reference 3 NMC committed to "provide Technical Specification changes to reference an acceptable surveillance methodology to support requested information in GL 2003-01, Item (c), for PBNP no later than 60 days following NRC approval of the license amendment request to implement use of the alternate source term." There is no change to this commitment.

Summary of Commitments The following revises the commitment date as stated in Reference 2. The proposed commitment change was discussed with the PBNP NRC Project Manager during a telephone conference on January 14,2008:

"FPLE-PB will submit a license amendment request to the NRC revising the current accident analysis for PBNP to demonstrate compliance with the dose limits of 10 CFR 50, Appendix A, GDC-19, using the Alternative Source Term by the end of 1Q09. As part of this submittal, the post-accident reliance on KI for control room staff will be addressed."

This matter has been entered into the corrective action program.
