Mr. Snyder -

Thanks for your interest in the status of PRM-26-3. On April 30, 2011, the NRC wrote a letter to Mr. Robert Meyer, then president of your organization, informing him of the agencys determination that the issues raised in PRM-26-3 are appropriate for consideration in the 10 CFR Part 26 Quality Control/Quality Verification rulemaking. The NRC also published a notice in the Federal Register on May 16, 2011, informing the public of the agencys plan to consider your petition in the aforementioned rulemaking.

Consideration of your petition in this specific rulemaking is the result of Commission direction, which can be found in SRM-SECY-11-0003.

The Quality Control/Quality Verification rulemaking is currently in the proposed rule phase, and the NRC has discussed your petition at length. The NRC has solicited feedback on PRM-26-3 in public meetings held on December 12, 2011, February 23, 2012, and October 18, 2012. In addition, the NRC is hosting a public meeting tomorrow, April 11, 2013, at which a primary discussion topic will be the definition of unit outage. This meeting will also be available via teleconference and webinar if you would like to participate. The webinar registration information, including the teleconference number, is attached. Please see the NRC meeting notice for further details.

This proposed rulemaking is scheduled to be complete near the end of this calendar year, at which time it will be reviewed and voted on by the Commission. Upon Commission

approval, the NRC will publish the proposed rule in the Federal Register, soliciting feedback from interested stakeholders. Following the public comment period, the NRC will consider all comments received and make appropriate adjustments to the rule. This final rule will then go back to the Commission for a vote, after which the NRC will publish the final rule in the Federal Register.

The rulemaking process will ensure a proper basis is developed, the public is engaged, and the costs and benefits of the rulemaking are fully assessed to produce sound, reasonable, and enforceable public policy.
