Notification Regarding Siren Project Milestone

Dear Sir or Madam; Entergy Nuclear Operations, Inc. (Entergy) provided, in Reference 1, a status update of the project milestones for placing the new Alert and Notification System (ANS) in service for the Indian Point Energy Center. Entergy has essentially completed the installation, testing, and training activities required for the new ANS to be operable and is ready to place the system in service on or before August 14, 2008. The August 14, 2008 milestone was based on receiving FEMA approval eight days prior (August 6, 2008) to the in-service date. Entergy is providing this notification that FEMA approval has not been received as of this date.
Entergy issued the new Design Report for the ANS on April 28, 2008 and Entergy has been actively working with FEMA to support their review. On July 30, 2008 Entergy issued (Reference 2) Supplement 3 to the Design Report, which provided additional information requested by FEMA technical reviewers during meetings held with Entergy on July 18 and July 22, 2008. Entergy participated in a follow-up meeting with the FEMA reviewers on August 4, 2008 to confirm that the information in the supplement adequately addressed the requested
NL-08-128 Dockets 50-247 and 50-286 Page 2 of 2 additional information needed for FEMA to complete their review. A document requested by FEMA during that meeting was provided by Entergy on August 5, 2008. On August 6, 2008 FEMA notified Entergy, by telecom, that additional time would be needed to reach a decision regarding approval to place the new ANS in service. The schedule for FEMA completing their review is undetermined at this time and Entergy will continue to work with FEMA to establish the schedule.
Entergy remains ready to place the new system in service by August 14, 2008 if FEMA approval is received by noon EDT on August 12, 2008. Entergy will continue to keep you apprised of this situation.
