Ladies and Gentlemen:

By letter NL-07-1760, dated September 17,2007 Southern Nuclear Operating Company (SNC) requested Nuclear Regulatory Commission (NRC) approval of proposed alternative Q1/2B13-RR-V-2 for the Farley Nuclear Plant (FNP) Unit 1 3rd 10-Year 1ST Interval and for Unit 2 until the end of the next Unit 2 refueling outage scheduled to begin October 18, 2008.

The relief request was submitted because during review of INPO Operating Experience Report OE25262 dated August 3, 2007 FNP initiated a review of the testing history for Class 1 Pressure Relief Valves and FNP realized that the Pressurizer Safety Valve surveillance procedure calculated the next test due date based on "install-to-test" instead of "test-to-test" date criterion. As corrective actions, the FNP Unit 1 Pressurizer Safety Valves have been replaced with valves that meet "test-to-test" criterion and the FNP Unit 2 Pressurizer Safety Valves will be replaced with valves that meet the "test-to-test" criterion during the fall 2008 refueling outage. A risk analysis was completed, in accordance with FNP Technical Specification SR 3.0.3, for the missed surveillance.

During several telephone conversations with the NRC, it was determined that completing the risk analysis, as required by FNP Technical Specifications, was the appropriate response for calculating the next test due date by using the "install-to-test" date criterion. In addition, this issue is documented in NRC Integrated Inspection Report 05000348/2008002 and 05000364/2008002 dated April 30, 2008.

Therefore, SNC hereby withdraws proposed relief request Q1/2B13-RR-V-2 for FNP Units 1 and 2. This letter contains no NRC commitments.
