Farley Nuclear Plant - Units 1 and 2 Request for NRC 95002 Inspection Schedule and Scope Ladies and Gentlemen:

On November 11, 2007, NRC Region II issued the "Assessment Follow-up Letter Joseph M. Farley Nuclear Plant." This NRC letter formally notified Southern Nuclear Operating Company (SNC) that Farley Nuclear Plant (FNP) Units 1 and 2 had moved into the Degraded Cornerstone column of the NRC's Reactor Oversight Process (ROP) Action Matrix. The NRC cited the following risk significant performance issues for the movement of both units to Column 3 of the Action Matrix:

Unit 1 White Performance Indicator (PI) for Cooling Water Systems (CCW) as a result of two CCW breaker failures to close; Unit 1 and 2 Parallel White PI Inspection Finding for identified weaknesses in the thoroughness and quality of root cause evaluations that challenged the plant's ability to implement effective overall corrective actions (issued in NRC Inspection Report 2007-008);

Unit 2 Yellow Inspection Finding for the Residual Heat Removal (RHR) containment sump suction valve failure to fully open on two occasions (issued in NRC Inspection Report 2007-011). The subject of this finding resulted in the White PI for RHR.

The staff further advised that the NRC should be notified when SNC is ready for the NRC to review the actions taken to address each of these issues, as described in the November 1'I letter. In a letter dated April 22, 2008, SNC requested that NRC conduct the Inspection Procedure (IP) 95002 inspection on June 2-13,2008.

Based on the November 11 letter and further discussion with NRC Region II, SNC requests that each of the issues identified above be included within the scope of the upcoming IP 95002 Inspection. In response to these issues, SNC has conducted four separate and extensive Root Cause Evaluations (RCEs): (1) Allis-Chalmers

Nuclear Regulatory Commission NL-08-0791 Page 2 4160 volt Breaker Failures, (2) Cutler-Hammer 4160 volt Breaker Failures, (3) RHR Containment Sump Suction Valve Failure, and (4) Corrective Action Program Deficiencies, including but not limited to an evaluation of extent of condition, extent of cause, and safety culture component contribution to the performance issues.

Consistent with IP 95002, SNC is prepared to demonstrate that the root and contributing causes for the risk significant performance issues identified in the November 11 letter have been identified and are understood; that the extent of condition and extent of cause have been assessed; that sufficient corrective actions have been taken or are being taken to address the root and contributing causes and to prevent recurrence; and that safety culture components that caused or significantly contributed to these risk significant performance issues have been identified and are being addressed.

The more recent issue involving the emergency diesel generators should not be included within the scope of the upcoming IP 95002 inspection.
