Dear Sir or Madam:

The purpose of this letter is to submit to NRC the siren project milestone schedule for the alert notification system (ANS) for the Indian Point Energy Center.

On January 24, 2008, (reference 1) the NRC issued a notice of violation and proposed imposition of civil penalty to Entergy Nuclear Operations, Inc. (ENOI) for failure to implement Orders issued by the NRC on January 31, 2006, (reference 2) and July 30, 2007 (reference 3). The two Orders, in part, require that ENOI place in service an ANS with a backup power capability.

On January 9, 2008, (reference 4) ENOI transmitted to FEMA for review and comment a proposed schedule setting out project milestones and completion dates. The milestone schedule included input from FEMA regarding the time estimates for FEMA review activities.

On January 30, 2008, a joint ENOI, FEMA and NRC meeting was held, during which the proposed milestone schedule was discussed. At this meeting, FEMA confirmed the time estimates for FEMA review activities with the presumption that ENOI will provide complete and accurate information. In addition, the NRC Regional Administrator requested at this meeting that ENOI formally submit the milestone schedule to the NRC. Accordingly, Attachment 1 to this letter contains the siren project milestone schedule. contains a listing of commitments made within this letter.

2 Completion of this activity is dependent upon ENOI obtaining third party governmental permits and approvals. The-estimated amount of days for completion are a rough estimate of 120 days based upon ENOI's prior experience but are subject to change. The timing of obtaining permits is highly variable based on the applicable jurisdiction and other factors determined by the relevant issuing governmental authority.

This completion date assumes that FEMA will not require any subsequent analysis or responses in connection with milestone 9 Corrected typo error to change 14 days to 21 days. This is consistent with the schedule estimated completion date.
