Ladies and Gentlemen:

Southern Nuclear Operating Company (SNC), the licensed operator for the Joseph M. Farley Nuclear Plant, the Edwin I. Hatch Nuclear Plant and the Vogtle Electric Generating Plant, has reviewed the notice regarding draft construction inspection program for reactors built under 10 CFR Part 52, that was published in the Federal Register on September 25, 2003 (68 FR 55416). Accordingly, SNC is in total agreement with the comments provided by the Nuclear Energy Institute (NEI) regarding this issue, which includes comments on the Nuclear Regulatory Commission's (NRC's) draft Construction Inspection Program (CIP)

Framework Document and the August 27, 2003 public workshop on that subject.

Based on the August 27, 2003 workshop, there are fundamental issues associated with the CIP and inspections, tests, analyses and acceptance criteria (ITAAC) verification process, as delineated in NEI's comments, that require further discussion. Because of the importance of these issues to the workability of the ITAAC process under Part 52, SNC looks forward to the opportunity to participate in future communications on this subject after the NRC has had a chance to consider all stakeholder comments.
