DISTRIBUTION OF PRODUCTS CONTAINING LICENSABLE QUANTITIES OF RADIOACTIVE MATERIAL To Whom It May Concern:
The U.S. Nuclear Regulatory Commission (NRC) is writing to inform you of the federal requirements governing the possession and importation of products containing plutonium or other licensable quantities of special nuclear material. You must have a valid NRC license to possess or import any such products.
Under 10 CFR 70.3, No person subject to the regulations in this part shall receive title to, own, acquire, deliver, receive, possess, use, or transfer special nuclear material except as authorized in a license issued by the Commission pursuant to these regulations. This requirement applies to any quantity of plutonium, regardless of form or intended use.
In addition, 10 CFR 110.5 requires that the import of nuclear material into the United States be authorized under a general or specific license. This provision applies to any importation of plutoniumcontaining items.
If you intend to possess, import, or transfer products containing plutonium in the future, you must first obtain the appropriate NRC license or approval from the relevant regulatory authority.
Possessing or transferring such material without proper authorization may result in significant regulatory or legal action.
