CATAWBA NUCLEAR STATION, UNITS 1 AND 2, AND MCGUIRE NUCLEAR STATION, UNITS 1 AND 2, - REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE RE: LICENSE AMENDMENT TO UPDATE ROD EJECTION ACCIDENT METHODOLOGY TO REGULATORY GUIDE 1.236, REVISION 0, PRESSURIZED-WATER REACTOR CONTROL ROD EJECTION AND BOILING-WATER REACTOR CONTROL ROD DROP ACCIDENTS, JUNE 2020 (EPID L-2025-LLA-0203)
Dear Mr. Gibby:
By letter dated December 22, 2025 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML25356A517), Duke Energy Carolinas, LLC, (the licensee, Duke Energy) submitted a license amendment request (LAR) for the Renewed Facility Operating Licenses for Catawba Nuclear Station, Units 1 and 2, and McGuire Nuclear Station, Units 1 and 2, related to the control rod ejection accident methodology. Specifically, Duke Energy requests The U.S. Nuclear Regulatory Commissions (NRC) review and approval of the proposed changes set forth in Revision 2 of DPC-NE-3001-P, Multidimensional Reactor Transients and Safety Analysis Physics Parameters Methodology. This will update methodologies to Regulatory Guide 1.236, Revision 0, Pressurized-Water Reactor Control Rod Ejection and Boiling-Water Reactor Control Rod Drop Accidents, June 2020 (ML20055F490).
In Attachment 1 of its letter date December 22, 2025, the licensee submitted an affidavit dated December 22, 2025, executed by Shawn Gibby, Vice President Nuclear Engineering, Duke Energy, requesting that the information contained in Attachment 2 of Duke Energy letter RA 0156 regarding the request to approve DPC-NE-3001-P, Revision 2, be withheld from public disclosure pursuant to Section 2.390 of Title 10 of the Code of Federal Regulations (10 CFR):
The affidavit stated that the submitted information should be withheld from public disclosure for the following reasons:
4(ii)(a)
The information requested to be withheld reveals the distinguishing aspects of a process (or component, structure, tool, method, etc.) whose use by a vendor, utility or consultant, without a license form Duke Energy would constitute a competitive economic advantage to that vendor, utility or consultant.
4(ii)(c)
Use by a competitor of the information request to be withheld would reduce the competitors expenditure of resources, or improve his competitive position, in the design, manufacture, shipment, installation, assurance of quality, or licensing a similar product.
The NRC staff has reviewed your application and the material in accordance with the requirements of 10 CFR 2.390 and, because of the statements in the affidavit, have determined that the submitted information sought to be withheld contains proprietary information and should be withheld from public disclosure.
Therefore, Attachment 2 of Duke Energy letter RA-25-0156 regarding the request to approve DPC-NE-3001-P, Revision 2, marked as proprietary will be withheld from public disclosure pursuant to 10 CFR 2.390(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.
Withholding public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, we may send copies of this information to our consultants working in this area. The NRC staff will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.
If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC. You also should understand that the NRC may have cause to review this determination in the future, for example, if the scope of a Freedom of Information Act request includes your information. In all review situations, if the NRC decides adverse to the above, you will be notified in advance of any public disclosure.
