Dear Mr. Bartelme:
By letter dated February 4, 2026, (Agencywide Documents Access and Management System Accession No. ML26035A419), SHINE Technologies, LLC. (SHINE) submitted an affidavit (ML26035A421) executed by you to the U.S. Nuclear Regulatory Commission (NRC) staff requesting the following information contained in Application for Order Approving Transfers of Construction Permit and Conforming Administrative Amendments (ML26036A312) be withheld from public disclosure pursuant to Title 10 of the Code of Federal Regulations (10 CFR), Section 2.390, Public inspections, exemptions, requests for withholding:
The estimated costs to complete construction in Table 1.
The amount of funding provided by the loan.
The affidavit stated that the submitted information should be considered exempt from mandatory public disclosure for the following reasons:
- a. This information is and has been held in confidence by SHINE.
- b. The information is of a type that is held in confidence by SHINE, and there is a rational basis for doing so because the information contains sensitive financial competitive information concerning SHINEs anticipated revenues and operating expenses.
- c. This information is being submitted to the NRC in confidence.
- d. This information has been marked in accordance with 10 CFR 2.390(b)(1).
- e. This information is not available in public sources and could not be readily gathered from other publicly available information.
- f. Although the following statement is no longer required following the Supreme Courts decision in Food Marketing Institute v. Argus Leader Media, the public disclosure of this information would create substantial harm to the competitive position of SHINE by disclosing its internal commercial, financial and proprietary information to other parties whose commercial interests may be adverse to those of SHINE.
The NRC staff have reviewed the affidavit and the material in accordance with the requirements of 10 CFR 2.390 and, on the basis of the statements in the affidavit, has determined that the submitted information sought to be withheld contains proprietary commercial information and should be withheld from public disclosure.
Therefore, the submitted information marked as proprietary will be withheld from public disclosure pursuant to 10 CFR 2.390(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended Withholding from public inspection will not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, the NRC staff may send copies of information to our consultants working in this area. The NRC staff will ensure that the consultants have signed the appropriate agreements for handling proprietary information.
If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, SHINE should promptly notify the NRC staff. SHINE should understand that the NRC staff may have cause to review this determination in the future, for example, the scope of a Freedom of Information Act request includes SHINE information.
In all review situations, the NRC staff will follow applicable laws, regulations, and policies in conducting its review, including the NRCs policies on notifying the owner of information in advance of any public disclosure.
