Revised Estimated Completion Date for Licensing Action Impacted by Government Shutdown (EPID: L-2025-LLA-0139)

Friday, January 30, 2026 8:03:00 AM The Federal Government was shut down from October 1 through November 12, 2025, resulting in a temporary suspension of most regulatory review activities at the U.S. Nuclear Regulatory Commission (NRC) in accordance with Management Directive 4.5, Contingency Plan for Periods of Lapsed Appropriations. As a result, the NRC is assessing the schedule impacts for all licensing actions.
The purpose of this email is to inform you that following its assessment, the NRC staff has determined the Diablo Canyon Nuclear Power Plant, Units 1 and 2, licensing action regarding the adoption of emergency action level scheme pursuant to Nuclear Energy Institute (NEI) 99-01, Revision 7, Development of emergency action levels for non-passive reactors, (EPID L-2025-LLA-0139) has been impacted and will not be completed by the estimated completion date provided to you previously. The NRC staffs revised estimated completion date is June 30, 2026, to support your exercise.
The revised estimated completion date could change due to several factors including requests for additional information and unanticipated addition of the review scope (e.g.,
regulatory audit). If emergent complexities or challenges arise that would result in a change to the estimated completion date or significant changes in the estimated hours, the reasons for the change, and a revised estimate will be communicated during routine interactions with the assigned licensing project manager and documented.
