Dear Mr. Lashley By letter dated December 11, 2025 (ML25345A241), you requested that specific information included with the letter be withheld from public disclosure pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Section 2.390.

The affidavit stated that the submitted information should be considered exempt from mandatory public disclosure for the following reasons:

(i) The information sought to be withheld has consistently been held in confidence by Holtec International.

(ii) Public disclosure of the information sought to be withheld is likely to cause substantial harm to Holtec Internationals competitive position and foreclose or reduce the availability of profit-making opportunities.

(iii) The information is part of Holtec International's SMR-300 technology base, and its commercial value extends beyond the original development cost.

(iv) Holtec Internationals competitive advantage will be lost if its competitors are able to use the results of the Holtec International experience to normalize or verify their own process or if they are able to claim an equivalent understanding by demonstrating that they can arrive at the same or similar conclusions.

Holtec International stated in the affidavit that the topical report information marked as proprietary fits the following specific category of proprietary information:

a. Information that discloses a process, method, or apparatus, including supporting data and analyses, where prevention of its use by Holtec's competitors without license from Holtec International constitutes a competitive economic advantage over other companies The NRC staff reviewed the affidavit and information provided in the letter in accordance with the requirements of 10 CFR 2.390. Based on the statements in the affidavit, the staff determined that the information sought to be withheld contains proprietary commercial information and should be withheld from public disclosure. Therefore, the information marked as proprietary will be withheld from public disclosure pursuant to 10 CFR 2.390(b)(5).

The NRC may have cause to review this determination in the future. If the NRC makes a determination adverse to the above, the submitter will be notified in advance of any public disclosure.
