ACCEPTANCE OF THE DECEMBER 10, 2025, WASTE CONTROL SPECIALISTS LLC REQUEST TO MODIFY ORDER CONDITIONS (CAC NO. 001542/DOCKET NO. 0707005/EPID NO. L-2025-LLO-0000)

Dear Mr. Williams:

On December 10, 2025, Waste Control Specialists LLC (WCS) sent a letter to the U.S. Nuclear Regulatory Commission (NRC) requesting modification of Conditions in the currently effective NRC Exemption Order to WCS. In the letter, WCS requested permission to: extend possession of the U.S. Department of Energy (DOE) Los Alamos National Laboratory (LANL) Waste at the WCS Low-Level Waste Disposal Site (WCS Site) near Andrews, Texas, until December 31, 2028; perform certain prepare for shipment activities with the LANL Waste; and remove no longer needed Order Conditions. The publicly available WCS request is available in the NRCs Agencywide Documents Access and Management System (ADAMS) at Accession No. ML25346A049.

The purpose of this letter is to provide the results of the NRC staffs acceptance review of your request. The acceptance review was performed to determine if there is sufficient information to allow the NRC staff to complete its review. The staff has reviewed your submittal and concludes that it does provide sufficient information to enable the NRC to complete its review. The NRC staffs detailed review may identify safety and environmental issues that necessitate requests for additional information (RAI). If additional information is needed to address these areas, you will be advised by separate correspondence.

The NRC expects to complete its accelerated safety, environmental, and security review under Condition No. 12 (i.e., NRC Response Letter to WCS) of the NRC Exemption Order to WCS by January 30, 2026. Based on the information provided in the WCS request, the NRC staff has estimated that the safety and environmental review will take approximately 100 staff hours to complete.

If there are emergent complexities or challenges in our review that would cause changes to the schedule, then the reasons for the changes and the new schedule will be communicated to both WCS and the State of Texas.

In accordance with 10 CFR Section 2.390, Public Inspections, Exemptions, Requests for Withholding, a copy of this letter will be available electronically for public inspection in the NRC December 23, 2025
