Dear Secretary Burgum:
January 21, 2026 On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am providing the agency's status report as required by Section 5(c) of the January 20, 2025, Executive Order (EO) 14156, entitled "Declaring a National Energy Emergency." On March 13, 2025, in accordance with Section 5(a) of the EO, the NRC submitted our initial summary report listing planned or potential actions to facilitate the Nation's energy supply that may be subject to the Endangered Species Act (ESA) regulation on consultations in emergencies. Section 5(c) further directs the heads of agencies to then submit a status report at least every 30 days for the duration of the national emergency following the submission of the initial summary report.
The NRC's status report is enclosed. The changes since the NRC's last status report are as follows:
October 2025 The following project has been removed from this report because ESA Section 7 consultation has been completed.
o Dewey-Burdock (Powertech (USA) Inc.), Uranium In-Situ Recovery Facility License Renewal November 2025 There were no changes in the status of ESA consultations in November.
The NRC received the following new applications, which have been moved from planned or potential licensing actions to current licensing reviews in this report.
o Crane Clean Energy Center (Constellation Energy Corporation), License Amendment Requests to restart operation of the power plant o
Duane Arnold Energy Center (NextEra Energy Duane Arnold, LLC), License Amendment Requests to restart operation of the power plant December 2025 One new planned or potential license application for a nuclear fuel cycle facilities project has been added to Section 10 of this report.
o General Matter, Inc., New Fuel Enrichment Facility License Application Per the direction in Section 5( c) of EO 14156, the NRC will continue to provide these status reports at least every 30 days for the duration of the declared national energy emergency.
