- GE VERNOVA HITACHI NUCLEAR ENERGY, LLC, PRESENTATION FOR PRE-SUBMITTAL MEETING FOR ULTRA PLUS CONTROL ROD LICENSING TOPICAL REPORT (EPID L-2025-LRM-0145)
Dear Mr. Halac:
By letter dated November 18, 2025 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML25322A389), GE Vernova Hitachi Nuclear Energy, LLC (GVH),
affidavit dated November 18, 2025, was executed and submitted by you in Enclosure 3 to the abovementioned letter, requesting that the information contained in Enclosure 1 be withheld from public disclosure pursuant to Title 10 of the Code of Federal Regulations (10 CFR), Part 2, Section 2.390.
Presentation for Pre-Submittal Meeting for Ultra Plus Control Rod Licensing Topical Report The nonproprietary copy of this document (Enclosure 2) has been placed in the U.S. Nuclear Regulatory Commissions (NRCs) Public Document Room and is available under ADAMS Accession No. ML25322A391.
The affidavit stated that the submitted information should be considered exempt from mandatory public disclosure based on a. and b. from the list below:
- a. The information that discloses a process, method, or apparatus, including supporting data and analyses, where prevention of its use by GVH competitors without license from GVH constitutes a competitive economic advantage over other companies.
- b. The information which, if used by a competitor, would reduce his expenditure of resources or improve his competitive position in the design, manufacture, shipment, installation, assurance of quality, or licensing of a similar product.
- c. The information which reveals aspects of past, present, or future GVH customer-funded development plans and programs, resulting in potential products to GVH.
- d. The information which discloses patentable subject matter for which it may be desirable to obtain patent protection.
The NRC staff has reviewed the affidavit and the material in accordance with the requirements of 10 CFR 2.390 and based on statements a. and b. in the affidavit, has determined that the submitted information that sought to be withheld contains proprietary commercial information and should be withheld from public disclosure.
Therefore, the version of the submitted information marked as proprietary will be withheld from public disclosure pursuant to 10 CFR 2.390(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, GVH should promptly notify the NRC. GVH also should understand that the NRC may have cause to review this determination in the future if, for example, the scope of a Freedom of Information Act request includes GVH information. In all review situations, the NRC will follow applicable laws, regulations, and policies in conducting its review, including the NRCs policies on notifying the owner of information in advance of any public disclosure.
