REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE
- GLOBAL NUCLEAR FUEL - AMERICAS, LLC, PRESENTATION FOR PRE-SUBMITTAL MEETING FOR PRIME LICENSING TOPICAL REPORTS (EPID L-2025-LRM-0110)
Dear Mr. Halac:
By letter dated September 30, 2025 (Agencywide Documents Access and Management System (ADAMS) Package Accession No. ML25273A208), Global Nuclear Fuel - Americas, LLC (GNF-A), you have submitted to the Nuclear Regulatory Commission (NRC) an affidavit executed by you on September 30, 2025, requesting that the information contained in Enclosure 1 to the above said letter be withheld from public disclosure pursuant to Title 10 of the Code of Federal Regulations (10 CFR), Part 2, Section 2.390.
Presentation for Pre-Submittal Meeting for PRIME Licensing Topical Reports The nonproprietary copy of this document (Enclosure 2) has been placed in the NRCs Public Document Room and is available under ADAMS Accession No. ML25273A210.
The affidavit stated that the submitted information should be considered exempt from mandatory public disclosure because it is:
- a. The information that discloses a process, method, or apparatus, including supporting data and analyses, where prevention of its use by GNF-A competitors without license from GNF-A constitutes a competitive economic advantage over other companies.
- b. The information which, if used by a competitor, would reduce his expenditure of resources or improve his competitive position in the design, manufacture, shipment, installation, assurance of quality, or licensing of a similar product.
- c. The information which reveals aspects of past, present, or future GNF-A customer-funded development plans and programs, resulting in potential products to GNF-A.
- d. The information which discloses patentable subject matter for which it may be desirable to obtain patent protection.
The NRC staff has reviewed the affidavit and the material in accordance with the requirements of 10 CFR 2.390 and based on the statements (a) and (b) in the affidavit, has determined that the submitted information sought to be withheld contains proprietary commercial information and should be withheld from public disclosure.
Therefore, the version of the submitted information marked as proprietary will be withheld from public disclosure pursuant to 10 CFR 2.390(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.
If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, Westinghouse should promptly notify the NRC. Westinghouse also should understand that the NRC may have cause to review this determination in the future if, for example, the scope of a Freedom of Information Act request includes Westinghouse information. In all review situations, the NRC will follow applicable laws, regulations, and policies in conducting its review, including the NRCs policies on notifying the owner of information in advance of any public disclosure.
