CATAWBA NUCLEAR STATION UNITS NO. 1; MCGUIRE NUCLEAR STATION NOS. 1 AND 2; - REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE RE: FULL SPECTRUM LOSS OF COOLANT ACCIDENT LICENSE AMENDMENT REQUEST, ENCLOSURE 2, APPLICATION OF WESTINGHOUSE FULL SPECTRUM LOCA EVALUATION MODEL TO MCGUIRE UNITS 1 AND 2 AND CATAWBA UNIT 1 (PROPRIETARY VERSION) (EPID L-2025-LLA-0132))
Dear Mr. Gibby:
By letter dated August 18, 2025, (Agencywide Documents Access and Management System (ADAMS) Accession No. ML25230A072) Duke Energy Carolinas, LLC (Duke Energy) submitted a request for a license amendment (LAR) to the Technical Specifications (TSs) for Catawba Nuclear Station, Unit 1 and McGuire Nuclear Station, Units 1 and 2. The proposed amendment requests the addition of the Westinghouse Electric Company LLC (Westinghouse) topical report WCAP-16996-P-A, Revision 1, Realistic LOCA Evaluation Methodology Applied to the Full Spectrum of Break Sizes (FULL SPECTRUM LOCA Methodology) (ADAMS Package Accession No. ML17277A130), to the list of approved analytical methods used to determine the core operating limits provided in TS 5.6.5, Core Operating Limits Report (COLR).
In Enclosure 3 of the letter dated August 31, 2025, Duke Energy submitted an affidavit dated July 23, 2025, executed by Jerrod Ewing, Manager of Operating Plants Licensing, on behalf of behalf of Westinghouse, requesting that the information contained in the following document be withheld from public disclosure pursuant to Section 2.390 of Title 10 of the Code of Federal Regulations (10 CFR):
Application of Westinghouse FULL SPECTRUM LOCA Evaluation Model to McGuire Units 1 and 2 and Catawba Unit 1 (Non-proprietary Version).
The affidavit stated that the submitted information should be withheld from public disclosure for the following reasons:
(5)(a)
The information reveals the distinguishing aspects of a process (or component, structure, tool, method, etc.) where prevention of its use by any of Westinghouse's competitors without license from Westinghouse constitutes a competitive economic advantage over other companies.
(5)(c)
Its use by a competitor would reduce his expenditure of resources or improve his competitive position in the design, manufacture, shipment, installation, assurance of quality, or licensing a similar product.
The Nuclear Regulatory Commission (NRC) staff has reviewed your application and the material in accordance with the requirements of 10 CFR 2.390 and, because of the statements in the affidavit, have determined that the submitted information sought to be withheld contains proprietary commercial information and should be withheld from public disclosure.
Therefore, the version of the submitted information marked as proprietary will be withheld from public disclosure pursuant to 10 CFR 2.390(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.
Withholding public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, we may send copies of this information to our consultants working in this area. The NRC staff will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.
If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC. You also should understand that the NRC may have cause to review this determination in the future, for example, if the scope of a Freedom of Information Act request includes your information. In all review situations, if the NRC makes a determination adverse to the above, you will be notified in advance of any public disclosure.
