Dear Mr. Gardner:

By letter dated July 30, 2025 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML25211A317), Kairos Power LLC (Kairos) submitted requests for exemptions from various requirements in Title 10 of the Code of Federal Regulations (10 CFR)

Part 55, Operators Licenses.

The purpose of this letter is to provide the results of the U.S. Nuclear Regulatory Commission staffs acceptance review of these requests. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the staff to complete its detailed technical reviews. The acceptance review is also intended to identify whether the submittal has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

The NRC staff has reviewed your submittal and concluded that it does provide sufficient technical information to enable the staff to begin its detailed technical review regarding the acceptability of the proposed exemptions. Given the lesser scope and depth of the acceptance review as compared to the detailed technical review, there may be instances in which issues that impact the staffs ability to complete the detailed technical review are identified despite completion of an adequate acceptance review. You will be advised of any further information needed to support the staffs detailed technical review by separate correspondence.

The NRC staff notes the relationship between these exemption requests and Kairos Topical Report KP-TR-026-NP, Operator Training and Testing Program for Non-Power Kairos Power Fluoride Salt-Cooled High-Temperature Reactors, which was submitted by letter dated July 11, 2025 (ML25192A231) and formally accepted for NRC review on August 7, 2025 (ML25210A446).

Specifically, the limitations proposed by Kairos on the use of the operator training and testing program described in KP-TR-026-NP include NRCs approval of the exemptions requested in its July 30, 2025, letter. Kairos requested that the NRC staff complete its review of these exemptions six months after acceptance. Given the connection between the exemption requests and KP-TR-026-NP, the NRC staff intends to review the TR and exemption requests concurrently. At this time, the NRC staff estimates issuing a draft safety evaluation for KP-TR-

026-NP by July 31, 2026. Therefore, NRC staff estimates completing its review of the exemption requests on or about July 31, 2026. The NRC staff estimates that this review will take approximately 400 hours0.00463 days <br />0.111 hours <br />6.613757e-4 weeks <br />1.522e-4 months <br /> to complete. These estimates are based on the NRC staffs initial review of the application, and they could change, due to several factors including requests for additional information, and unanticipated addition of scope to the review. Given that these exemptions are first-of-a-kind requests, the NRC staff notes that there may be emergent complexities or challenges in our review that would cause changes to the initial forecast completion date or significant changes in the forecast hours. If this occurs, the reasons for the changes, along with the new estimates, will be communicated during routine interactions.
