BROWNS FERRY NUCLEAR PLANT, UNIT 1 - CORRECTION TO RENEWED FACILITY OPERATING LICENSE NO. DPR-33
Dear Mr. Erb:
During the issuance of the Renewed Facility Operating License No. DPR-33 on May 4, 2006 (ADAMS Package Accession No. ML060970269), the U.S. Nuclear Regulatory Commission (NRC) staff issued the renewed license pages for Browns Ferry Nuclear Plant (BFN), Unit 1. In paragraph 1 of Renewed Facility Operating License (RFOL) No. DPR-33 (ML061110094), the NRC staff incorrectly listed the license issuance date of the operating license as December 20, 1973. The correct date of issuance for Facility Operating License (FOL) No. DPR-33 is June 26, 1973 (ML013610129), as identified in paragraph 2 of RFOL No. DPR-33.
The expiration date for FOL No. DPR-33 was initially midnight on December 26, 1974. By letter dated December 20, 1973 (ML013610126), the Atomic Energy Commission amended FOL No.
DPR-33 in its entirety and revised the expiration date to midnight on May 10, 2007, which was 40 years from the date of issuance of Construction Permits Nos. CPPR-29 and CPPR-30, which were issued on May 10, 1967 (ML013610161, Non-Publicly Available). On May 19, 1989 (ML020030013), the NRC issued Amendment Nos. 167, 166, and 138, to FOL Nos. DPR-33, DRP-52, and DPR-68, respectively, which changed the expiration date for BFN, Unit 1, from May 10, 2007, to December 20, 2013; for BFN, Unit 2, from May 10, 2007, to June 28, 2014; and for BFN, Unit 3, from July 31, 2008, to July 2, 2016. When RFOL No. DPR-33 was issued on May 4, 2006, the license expiration date was extended to May 4, 2033.
The incorrect listing of the issuance date of FOL No. DPR-33 in paragraph 1 of the license occurred during the NRCs issuance of RFOL No. DPR-33 and was an administrative error. The NRC staff concludes that the incorrect date of issuance in paragraph 1 of RFOL No. DPR-33 does not change the staffs previous conclusion in the safety evaluation for issuance of RFOL No. DPR-33 on May 4, 2006, nor does it affect the expiration date of the RFOL.
Enclosed, please find corrected page 1 of RFOL No. DPR-33 for BFN, Unit 1. A revision bar in the right margin identifies the area that has been corrected.

The Nuclear Regulatory Commission (NRC or the Commission), having previously made the findings set forth in License DPR-33 issued on June 26, 1973, has now found that:
A.
The application for license filed by the Tennessee Valley Authority (TVA or the licensee) complies with the standards and requirements of the Atomic Energy Act of 1954, as amended (the Act), and the Commission's rules and regulations set forth in 10 CFR Chapter I and all required notifications to other agencies or bodies have been duly made; B.
Construction of the Browns Ferry Nuclear Plant, Unit 1 (the facility) has been substantially completed in conformity with Construction Permit No. CPPR-29 and the application, as amended, the provisions of the Act and the rules and regulations of the Commission; C.
Actions have been identified and have been or will be taken with respect to (1) managing the effects of aging during the period of extended operation on the functionality of structures and components that have been identified to require review under 10 CFR 54.21(a)(1); and (2) time-limited aging analyses that have been identified to require review under 10 CFR 54.21(c), such that there is reasonable assurance that the activities authorized by the renewed operating license will continue to be conducted in accordance with the current licensing basis, as defined in 10 CFR 54.3, for the facility, and that any changes made to the facilitys current licensing basis in order to comply with 10 CFR 54.29(a) are in accordance with the Act and the Commissions regulations; D.
The facility will operate in conformity with the application, as amended, the provisions of the Act, and the rules and regulations of the Commission; E.
There is reasonable assurance: (i) that the activities authorized by the renewed operating license can be conducted without endangering the health and safety of the public, and (ii) that such activities will be conducted in compliance with the rules and regulations of the Commission; F.
The licensee is technically and financially qualified to engage in the activities authorized by this renewed operating license in accordance with the rules and regulations of the Commission; G.
The licensee has satisfied the applicable provisions of 10 CFR Part 140, "Financial Protection Requirements and Indemnity Agreements," of the Commission's regulations;
